Wheeling & Dealing in MCMC? Part 7 – Dato’ Sharil singlehandedly appointed Nuemera Sdn Bhd …

The extremely learned Yg Bhg Dato Mohamed Sharil Bin Mohamed Tarmizi, the chairman of MCMC, who continues to indulge in his elegant silence on the issues involving MCMC appointing dormant companies. It is hoped that he will spare a bit of his time from his BIG SHOW “KL CONVERGE” to address the issues published thus far.

 

The very learned Yg Bhg Dato’ Mohamed Sharil vin Mohamed Tarmizi (Dato’ Sharil) was appointed the Acting Chairman of MCMC from 1-5-2009 until 15-10-2011.  On 16-10-2011 he was appointed Chairman of MCMC.  As at this date, he has been the Chairman of MCMC for a total of 5 years and 4 months.

 

Perhaps the 5 years and 4 months have gone to his head that indulging in his elegant silence and/or on his ego trip is a matter of right as the supreme head of MCMC.  He has forgotten that he is holding a public office and is accountable for all his actions.  He has to be transparent in what he does and subject himself to good governance.  Indulging in his elegant silence and/or on his ego trip at this stage will only bring disrepute to MCMC and the Government as a whole.

On 12-10-2009 five months after being appointed Acting Chairman, Dato’ Sharil singlehandedly appointed a dormant company known as Nuemera Sdn Bhd to provide a “Public Cellular Blocking Service (“PCBS”) System that enables the process of blocking and unblocking of reported lost or stolen cellular mobile access devices’s International Mobile Equipment Identity (IMEI) numbers across all public cellular service providers’ network.  Of course, Dato’ Sharil is a powerful man indeed!   Please take note that the above said letter of appointment was addressed to one Datuk Mohd Amin.  Of course, Datuk Mohd Amin is a director and shareholder of Nuemera Sdn Bhd, HERE.

Perhaps Dato’ Sharil might want to confirm whether this is the Datuk Mohd Amin that he was referring to in the said letter of appointment?

 

On 2-8-2013 the extremely learned and powerful Dato’ Sharil, the Chairman of MCMC, spoke about implementation of International Mobile Station Equipment Identity (IMEI) and he had given ultimatum to telcos to take part in this scheme.  Apparently, the telcos stood their ground and refused to participate in this “scheme”.  In the same story, the Star has published:

 

Malaysia Central Equipment Identity (MCEIR) will be operated by the MCMC, which has outsourced the managing of the system to Nuemera Malaysia Sdn Bhd.  The deal was signed about two months ago. Please see HERE.

If according to the said report in the Star, the deal was signed about two months ago then it should be around June 2013.  Please see page 1 of the said letter of appointment which was dated 12-10-2009. Which version is correct i.e. deal signed in June 2013 or October 2009?

 

As at 3-9-2014, Nuemera Sdn Bhd is a dormant company.  Recently MCMC has also appointed another dormant company known as  Orenda Kuantum Digital Sdn Bhd to provide Programe Management Office (PMO) to oversee the National Digital Project, which has been awarded to Puncak Semangat Sdn Bhd.

 

Below is the full set of the said MCMC letter of appointment which was signed by the then very powerful Acting Chairman, Dato’ Mohamed Sharil Bin Mohamed Tarmizi.

Please look at Clause 2.4 at page 3 of the said letter of appointment which provides that before the signing of the contract, MCMC will do a cost validation audit to ensure that the project implementation costs  … for the establishment of PCBS Systems are cost based, fair and nondiscriminatory.  Rumours have it that the formal contract was signed between MCMC and Nuemera Sdn Bhd without carrying out cost validation audit.

 

Please also look at Clause 2.7 at page 3 of the said letter of appointment which provides Nuemera Sdn Bhd’s terms of appointment shall be for a period of five years commencing from the date of this letter (12-10-2009) and SHALL BE EXTENDED FOR A FURTHER PERIOD OF FIVE YEARS.  MCMC is very generous when it comes to duration of contract with third party like Nuemera Sdn Bhd.  The then Acting Chairman of MCMC, Dato’ Sharil, was a strong believer in long duration for contract of this nature.  How about PMO contract for Orenda Kuantum Digital Sdn Bhd?

Page 5. The letter was addressed to Datuk Mohd Noor Amin but it was agreed upon and signed by Datin Shariza Binti Kamaruzzaman.  Who is this Datin Shariza Binti Kamaruzzaman?

 

Although the telcos have refused to participate in the PCBS/IMEI and/or pay their contribution of RM2.20 per subscriber to Nuemera Sdn Bhd as per clause 2.5 in the said letter of appointment, MCMC, being a philanthropist, proceed to pay Nuemera Sdn Bhd ten of million Ringgit on behalf of telcos.  This fact has been confirmed by a high ranking officer in MCMC in HERE.

 

The learned Dato’ Sharil should break his elegant silence to clarify the following:

 

  1. What are his relationship with Datuk Mohd Noor Amin Bin Mohd Noor Khan, En Nur Jasni Bin Mohamed, Datin Shariza Binti Kamaruzzaman and Puan Norliah Binti A P Kunhibava, HERE?

  2. Why there was no open tender held to appoint Nuemera Sdn Bhd to provide the PCBS/IMEI?

  3. How could he, as the Acting Chairman of MCMC, evaluate Nuemera Sdn Bhd when it is a dormant company until now?

  4. How could he, as Acting Chairman of MCMC, evaluate Nuemera Sdn Bhd’s charge of RM2.20, which is believed to have now been reduced to RM1.50) per subscriber  are cost based, fair and nondiscriminatory without carrying out a cost validation audit as provided under Clause 2.4 of the said letter of appointment?

  5. As at this date, is it true that MCMC has paid about RM35 million to the dormant company Numera Sdn Bhd for this PCBS/IMEI Scheme?

  6. When did he formally sign the contract with Nuemera Sdn Bhd?

  7. Was the special condition “if telcos did not pay their contributions to MCMC for PCBS/IMEI Scheme, MCMC shall pay to Nuemera Sdn Bhd” incorporated into the contract signed between MCMC and Nuemera Sdn Bhd?

For the sake of the image of MCMC, Ministry of Information and more importantly the Government, it is hoped that the very learned now Chairman of MCMC for 5 years and 4 months, Yg Bhg Datuk Sharil, will spare a bit of his time from his very big SHOW of all times – “The KL Converge” to clarify the above simple questions and other questions raised on the appointment of another dormant company, Orenda Kuantum Digital Sdn Bhd.

 

If Dato’ Sharil is in the mood, we would welcome his clarifications on his big Show “KL Converge” i.e. the name of event company, total cost and who paid for this event including the many suite rooms booked in Mandarin Oriental?  Yours truly heard from the grapevine that all the main telcos were indulging in paying for the Big Show “KL Converge”.   Lets hope that such indulgence will bear fruits in the very near future.  If it doesn’t bear fruit, there is no worry we, the subscribers, will be the ultimate suckers to pay for of all these stupid exercises.  No wonder our telecommunication/broadband charges are higher than in UK or USA and we got less service too.

 

MCMC or Sharil BOLEH … ?
