Little Napoleons’ “Speedy Gonzales” Attempt To Secure Promotion Of Datuk Musa Foiled

The Tourism Malaysia (TM) Board of Directors has foiled an attempt by the ‘Little Napoleons’ in TM to use an old letter of clearance or good character by the Malaysia Anti-Corruption Commission (MACC) to support the promotion of Datuk Musa  Bin Yusuf as Director General (DG) of TM.

The ‘Little Napoleons’ in Human Resources Department of TM (HR) head by its Director, Puan Rafidah Idris (Rafidah) and her deputy Tuan Ahmad Johanif Bin Mohd Ali (Ahmad Johanif) have been ordered to get a fresh letter of clearance or good character on Datuk Musa Bin Yusuf from MACC.

KSU Of MOTAC & KSN To Take Actions

Just to digress a little, Ahmad Johanif is free to support whichever party he wants but as a civil servant he must be neutral.  As a civil servant, he is governed by the General Orders, HERE. The KSU of MOTAC and KSN should look into the conduct of Ahmad Johanif during the 14 GE and the only few postings in his Facebook reproduced above. There are more negative postings of PH government and YAB Tun Dr  Mahathir!

TM’s Board Meeting of 25 March 2019

On 25 March 2019, the Board of Directors was presented with the papers to recommend or support the promotion of Datuk Musa Bin Yusuf to the rank of Jusa B as a prelude to confirm him as the Director General of TM.  The HR headed by Rafidah and Ahmad Johanif included amongst other documents there was a one year old letter of clearance or good character of Datuk Musa Yusuf from MACC to support his promotion.

Both of them knew or ought to have known that the standard procedure for proposing an officer for high ranking promotion in TM must be supported by current letter of clearance or good character from MACC.  Yet these two Little Napoleons saw it fit to knowingly overlook this elementary procedure for special reason best known to two of them.

By the way the ‘Little Napoleons’  Raffish was recently promoted as Director of HR and Ahmad Johanif was recently transferred to be her deputy after the “Speedy Gonzales” elevation of Datuk Musa Bin Yusuf as the DG of TM, HERE.

The Scandalous ‘Speedy Gonzales” RM99.693 Million

If these two ‘Little Napoleons’ were to carry out their duties diligently, they would have known that TM is currently burdened with the scandalous “Speedy Gonzales” RM99.673 million Geeko Tech Sdn Bhd’s (GEEKO) deal, HERE. They knew in mid January 2019 from the massive publicities generated by the arrest and remand of Dato’ Dr Siew Ka Wei, who at the material time when the said scandalous deal was struck on 4 April 2018 was the chairman of TM, and Ms Elizabeth Ken Tzu Ying by MACC for four days, HERE.

Dato’ Dr Siew Ka Wei is the former chairman of TM and current executive chairman of Ancom Bhd, MD of Nylex Bhd and MD of Redberry Media Group (Redberry).  Dato’ Dr Siew Ka Wei is also the directors of many outfits namely, Meru Utama Sdn Bhd (awarded with 10 years exclusive advertising space contract in KLIA), Titanium Compass Sdn Bhd (awarded with exclusively 10 years advertising space contract in MRT stations) and others. The defunct Malay Mail is part of Redberry.  Ms Elizabeth Ken Tzu Ying is the media specialist of Redberry. Ms Elizabeth Ken is the share holder and CEO of GEEKO

These two ‘Little Napoleons” Rafidah and Ahmad Johanif were apparently suffering from very severe wilful blindness when the proposal papers were prepared to support the promotion of Datuk Musa Bin Yusuf for the Board of Directors of TM for approval.  They knowingly omitted to present the glaring facts below with the predominant purpose to deceive or at best mislead the Board of Directors of TM into approving the promotion of Datuk Musa Bin Yusuf.

These two ‘Little Napoleons” should be suspended and face disciplinary actions for serious misconducts for knowingly presented the outdated MACC letter of clearance for Datuk Musa Bin Yusuf.

The Glaring Facts

  • When Geeko Tech Sdn Bhd (GEEKO) was incorporated on 6 November 2017 and Koperasi Kakitanggan Kementerian Pelancongan Kebudayaan Malaysia Bhd (also known as KOPEMA) was one of its shareholder holding 10,000 shares, HERE;
  • Datuk Musa Bin Yusuf is the President of KOPEMA;
  • The Datuk Musa Bin Yusuf‘s infamous “Promos Bersama” of 19 January 2018;

  • On 19 January 2018 Datuk Musa Bin Yusuf, the then Director of International Promotion (Africa/China) submitted a proposal known as “Promosi Bersama Dengan Tourism Malaysia Dan Tencent/Geeko Bagi Promosi Pemasaran Digital (Smart Tourism)” (“Promosi Bersama”) cost TM a whooping RM1,167,900.00, to the then DG of TM, Datuk Seri Mirza Bin Mohamed Taiyab (Datuk Seri Mirza).  Please read HERE  & HERE
  • The said Infamous “Promos Bersama”, of course, approved in lighting speed by the then DG of TM, Datuk Seri Mirza.
  • TM paid Geeko RM1,167,900.00 in lightning speed for the so-called “Promosi Bersama”, which Datuk Musa’s Bin Yusuf told the press that he was not aware of and he had instructed his officers to look into the matter, HERE & HERE;
  • Until now there no news of Datuk Musa Bin Yusuf’s investigation into his  Infamous “Promosi Bersama” that cost TM RM1,167,900.00;
  • Prior to the so-called “Promosi Bersama” of Datuk Musa Bin Yusuf, TM was already trying to appoint Deloitte Singapore and/or Deloitte Malaysia to conduct a ‘kajian” on the similar subject of digital marketing.  However, the appointment did not materialise.

The infamous “Promosi Bersama” was not a joint promotion but in reality it was a scheme devised to appoint GEEKO to prepare a so-called “kajian” to pave the way for TM to enter into the scandalous “Speedy Gonzales” RM99.693 million contract with GEEKO, which deal was evaluated, negotiated and agreement was prepared and executed in one day on 4 April 2018.

Luckily the Board of Director spotted the glaring flaw in the supporting documents to promote Datuk Musa Yusuf i.e. the outdated letter of clearance or good character of him from MACC.  However, the Board approved the proposal in principle subject to the submission of a current dated letter of clearance or good character from MACC for Datuk Musa Yusuf and to be approved by KSN.

MACC should go deeper into the scandalous “Speedy Gonzales” GEEKO RM99.693 million deal by digging into the KOPEMA shareholding in GEEKO and said infamous “Promosi Bersama” by Datuk Musa Bin Yusuf.

Can Serving Civil Servant Hold Post In A Private Entity?

The original version of MYBeauty’s website shown that Datuk Rashidi Bin Hasbullah, the then KSU of MOTAC, was the Chairman of MyBeauty. Advertisement and promotion were by Tourism Malaysia (TM) and MyBeauty.

As on 14 February 2019 Datuk Rashidi Bin Hasbullah (Rashidi), the then KSU of Ministry of Tourism and Cultures (MOTAC), was the Chairman of MyBeauty, HERE.

After the publication of the article, HERE, on 24 February 2019 there were drastic changes made to MyBeauty’s website where Rashidi was no longer designated as MyBeauty’s Chairman, HERE.

Rashidi Is Still the KSU of MOTAC

However, as of 20 March 2019 MyBeauty’s website shows Rashidi is still the KSU of MOTAC.  As a matter of fact, Rashidi had since retired on 15 February 2019.  As from 15 February 2019 MyBeauty’s website should clearly state that Rashidi was the ex-KSU of MOTAC. To state otherwise will be most misleading and does not speak well of MOTAC.

“Pekeliling Perkhidmatan” 

The current KSU of MOTAC, Datuk Isham Bin Ishak, should investigate into the position of Rashdi when he was the then KSU of MOTAC and chairman of MyBeauty at the same time. Whether at that material time Rashidi had violated the rules/regulation set by the government for serving civil servants holding post in a private entity.

It must be noted that under the Government’s “Pekeliling Perkhidmatan Bil. 7 Tahun 1982 [JPA.Sulit TT.8023/Jld.3/(17).]  Siri No: 006” (“Pekeliling Perkhidmatan”)

Section 4.1: Dengan ini Kerajaan telah memutuskan bahawa:

  • (a)  “Kakitangan kerajaan yang menjadi ahli Koperasi/Tabung/Kesatuan Sekerja Kakitanggan Awam tidak boleh mengangotai lembaga pengarah syarikat yang ditubuhkan oleh badan-badan itu, sama ada secara persendirian atau ushasama (joint venture); (Civil servant, who is a member of a co-operative/fund/association of civil servants, cannot become member of the Board of director of the company, which was set up by co-operative/fund/association of civil servants, whether in private or joint venture.)
  • (b)  Kakaitangan kerjaan tidak dibenarkan dilantik atas nama persendirian (private capacity) dalam lembaga pengarah bagi mana-mana syarikat. (Serving civil servant is not allowed in his personal capacity to be appointed to the Board of Directors of any company.)

 

As of 14-2-2019  MyBeauty’s website shown that it was established by MOTAC, Tourism Malaysia, Oriental Mace, HRDF and TRIPS.

As on 14 February 2019, it was stated in MyBeauty’s website that it was established by MOTAC, Tourism Malaysia, Tourism Malaysia (TM), Human Resources Development Fund (HRDF), Oriental Mace and TRIPS (Tourism Research Institute for Policy Studies).

 

On 23.2.2019 MyBeauty’s website shown that it was established by MOTAC and Malaysian Beauty College.

On 24 February 2019 MyBeauty had amended its website as shown above to state that it was established only by MOTAC and a new entity called “Malaysian Beauty College”. 

From 13 March 2019 onward the link to Malaysian Beauty College, HERE,  showed that the website had been deleted. Why?

The KSU of MOTAC Should Investigate

In the light of the above “Pekeliling Perkhidmatan”, the new KSU of MOTAC, Datuk Isham Bin Ishak, should investigate whether at the material time Rashidi had flagrantly violated the above “Pekeliling Perkhidmatan” and whether it was proper for Rashidi to be described as the KSU of MOTAC when he had actually retired on 15 February 2019.

Ancom Acquisition Of Dormant Company Is Puzzling

It would have been an otherwise a normal affair for a public listed company to acquire shareholding in a Sdn Bhd.  What had made it so strange was the acquisition of a dormant company with a RM1 paid up share capital.

On 1 March 2019 Ancom Bhd (Ancom) had made the above public announcement in Bursa Malaysia that it had acquired one ordinary share in Media Works Sdn Bhd (Media Works), which was incorporated on 13 December, 2018, and it is dormant. Isn’t it a bit unusual to classify a 13 months old as dormant?

Of course, the announcement didn’t tell us that Media Works has  several special common features with other companies, which are connected with Dato’ Dr Siew Ka Wei, Datuk Wong Sai Wan and Ms Elizabeth Ken Tzu Ying.

The registered office of Media Work is the same as Geeko (Elizabeth Ken is the CEO & shareholder), En Vogue Media Sdn Bhd is one the shareholder of Geeko (Elizabeth Ken is the director & shareholder of En Vogue Media Sdn Bhd), Puncak Berlian Sdn Bhd (Dato’ Dr Siew Ka Wei & Datuk Wong Sai Wan are the directors), Titanium Compass Sdn Bhd Dato’ Dr Siew Ka Wei & Datuk Wong Sai Wan are the directors) and Nylex (Malaysia) Bhd (Dato’ Dr Siew Ka Wei is the Group MD).

  • Geeko Tech Sdn Bhd (involved with the ‘Speedy Gonzales” contract worth RM99.693 million with TM and Elizabeth Ken is its CEO and shareholder)
  • En Vogue Media Sdn Bhd (belongs to Elizabeth Ken & her sister)

Geeko was involved in the dubious ’Speedy Gonzales’ digital platform direct nego contract worth RM99.693 million with Tourism Malaysia (TM), HERE.

At the material time, Datuk Musa Bin Yusuf (Musa) was the then director of International Promotion for (Africa/China) and is the president of KOPEMA.  The deputy president is Datuk Ammar A Ghapar, senior director of Domestic & Events of Tourism Malaysia (TM), HERE.

On 19 January 2018, Musa  submitted a proposal known as “Promosi Bersama  Tourism Malaysia dan Tencent/Geeko Tech Bagi Pemasaran Digital (Smart Tourism)” (“Promosi Bersama”) to the then DG of TM, Datuk Seri Mirza Mohamed Taiyab (Mirza), for approval.  It was, of course, approved in lightning speed by Mirza.

It would appear that it was a straight forward “Promosi Bersama”.  It was not. To cut the long story short, the said Promosi Bersama was so devised to appoint Geeko to do a study to appoint Geeko to put in place the so-called digital platform for RM99.693 million in TM.  This so-called study cost TM a whooping RM1,167,900.00. On 4 April 2018 (Iin one day) TM evaluated, negotiated, agreement prepared and the agreement was sealed on the same day.  Elizabeth Ken Tzu Ying (Elizabeth Ken) executed the said agreeement on behalf of Geeko and Mirza for TM. By the way, Geeko was only rgistered with Ministry of Finance on 6 April 2018, two days after signing the said agreement. It was a case of putting the cart before the horse!

Ms Elizabeth Ken is the CEO of Geeko Tech Sdn Bhd. She is also the media specialist of Redberry Media Group.

Dato’ Dr Siew Ka Wei, The Corporate Genius

Dato’ Dr Siew Ka Wei is the executive chairman of Ancom Bhd.  He is also the group managing director of Nylex (Malaysia) Bhd.  Redberry Media Group (Redberry) is also part of Ancom. The defunct Malay Mail (print edition) was part of Redberry. Redberry is a one of the outfits related Dato’ Dr Siew Ka Wei.

Dato’ Dr Siew Ka Wei and Tan Sri Mohamed Al Amin are business partners. Prior to the 14th General Elections. Dato’ Dr Siew Ka Wei had been hailed to be a corporate genius in Malaysia. Hence, many of his related outfits like Ancom Chemical Sdn Bhd (supply of Methanol from Petronas), Meru Utama Sdn Bhd (advertising space contract in airports) , Titanium Compass Sdn Bhd (advertising contract in MRT stations) and etc have been awarded with long term exclusive contracts.

Titanium Compass Sdn Bhd had been awarded 10 years exclusive advertising space contract in MRT stations, HERE. The PH Government should investigate into this and other monopoly contracts. Monopoly contract is never good for our country and should be terminated.

When yours truly exposed the shady “Speedy Gonzales” Geeko deal on 30 May 2018, Dato Dr Siew Ka Wei was the Chairman of Tourism Malaysia (TM), HERE.

He was actively defending the said dubious RM99.693 million deal. Initially he was in great pain to fool Malaysians that Geeko was a special purpose vehicle chosen by Tencent Holding for the “Speedy Gonzales” RM99.693 million project.

In a press statement dated 1 June 2018, Dato’ Dr Siew Ka Wei said:

Geeko Technology was the local partner chosen by Tencent to implement the project here. The principal officers are known to the Tencent Group. The choice of Geeko as a Special Purpose Vehicle for the project was made by Tencent.

One week later on 8 June 2018, Dato’ Siew Ka Wei did an about turn to drastically change the position by stating that:

Geeko Tech is not a special purpose vehicle chosen by Tencent …

The “Famous” Editor In Chief Of The Defunct Malay Mail, Datuk Wong Sai Wan

Malay mail editor in chief, Datuk Wong Sai Wan, pressing the button on 30-11-2018 to finally bury Malay Mail for good.

Malay Mail’s editor-in-chief is none other that the extremely “famous” Datuk Wong Sai Wan, who featured very prominently as director in at least two of Dato Dr Siew Ka Wei’s related outfits namely, Puncak Berlian Sdn Bhd and Titanium Compass Sdn Bhd.  It is not the norm for editor in chief of a newspapers to be director of companies. This is how Datuk Wong Sai Wan maintains his professionalism as the editor in chief.

 

MACC

On 7 June 2018 MACC had commenced its investigations into this dubious “Speedy Gonzales” Geeko deal. It raided TM HQ and seized documents. However, the then DG of TM, Datuk Seri Mirza Mohamed Taiyab denied it was a raid but just to visit TM Hq and “inquire” into the said dubious deal, HERE.

On 9 January 2019, Dato Dr Siew Ka Wei, the former chairman of Tourism Malaysia and chairman of Ancom Bhd and Group MD of Nylex Bhd, and Elizabeth Ken, the CEO, shareholder of Geeko and media specialist for Redberry Media Group, were arrested and subsequently detained by MACC for four days on a court order, HERE.  Please see also Star report, HERE.

Were the above features in Geeko and EN Vogue Media that were common with companies related to the outfits of Dato’ Siew Ka Wei and his Malay Mail’s editor in chief, Datuk Wong Sia Wan, a mere coincidence?

Perhaps Dato’ Dr Siew Ka Wei would like to defend the above like what he did on the scandalous “Speedy Gonzales” Geeko RM99.693 million deal.

MAVCOM For Consumer Protection

Updates at 2:30 pm on 7 March 2019:  It is not usual for the Minister of Transport to come out so quickly to stop the rumour that MAVCOM to be disbanded, HERE.  

The question is “Which person or airline started the rumour?”.  The Minister of Transport (MOT) should stop to dance to the tune of certain airline.  It is not good for the image of the MOT, MOT should be fair to all airlines. MOT must not be seen to favour one airline against the others. Please take note Mr MOT.

MOT should assist MAVCOM to stop the practices of imposing “hidden charges” by all airlines. Hidden charges must be the things of the past.

Of late, yours truly has observed that there were calls for the abolishment of Malaysian Aviation Commission (MAVCOM) and wondered what suddenly triggered this or more appropriately, who triggered this call.

For those unfamiliar with the entity, MAVCOM was established by Malaysian Aviation Commission Act, 2015  and was officially established on 1 March, 2016.  MAVCOM is an economic regulator, taking care of economic and commercial matters in the local civil aviation sector with the ultimate objective to support economic growth for the country.

MAVCOM Protects Consumer

MAVCOM also plays a big role in Consumer Protection and attending to complaints by the traveling public against airlines and airport services, HERE.

After the establishment of MAVCOM, there is now an official body to attend to public complaints against airline and monitor the commercial activities of all airlines in Malaysia.

It is now very easy for traveling public to lodge complaints against the services or commercial activities of any unscrupulous airlines in HERE.

Misleading Advertisement On Air Ticket Prices By AirAsia & AirAsia X

AirAsia & AirAsia X were both fined RM160,000.00 each for misleading ticket prices.

On 4 December 2018 it was reported that MAVCOM imposed RM160,000.00 fine each against AirAsia (AA) and AirAsia X (AAX) for violating the Malaysian Aviation Consumer Protection Code 2016 (MACP) in the 2nd quarter of 2018. AA and AAX had advertised misleading air ticket prices, HERE & HERE.

MAVCOM Continues To Focus On Consumer Protection

Out of all the public complaints received, 99.7% of them have been resolved, HERE & HERE.

If you are a traveler, you can relate how frustrating it can be sometimes with the level of service provided by the airline and airport.  Even before the journey itself, when you purchased your tickets, you are faced with hidden charges, which clearly reflect the conniving nature of certain airlines.

In ensuring that passengers continue to be protected, MAVCOM launched the Consumer Report. This report captures the complaints by passengers.  As at September 2018, for its fourth issue, they saw an increase in the number of complaints received from consumers. Complaints can now be lodged online with MAVCOM, in HERE.

The Quality of Service Framework is to ensure that the airport gives passengers an acceptable level of service from toilet cleanliness, to directions in the airport to customer service, in HERE.

Passenger Service Charge (PSC)

Certain irresponsible elements have gone on a disinformation exercise to state that PSC is collected by MAVCOM.  PSC is collected by he airlines when one purchase the airline tickets and the airline is legally obliged to handover the PSC of the departed passengers to MAHB.

The PSC rates were determined by professionals, analysts and economists commissioned by MAVCOM. The PSC numbers are not being plucked out of the air. Yours truly believes that it was a laboriously research before it is implemented. It must be noted that the current PSC rates in Malaysia remain among the lowest in the world.

Why Does MAVCOM Take The Trouble To Develop These Programmes?

It is to ensure that the traveling public get the best service out of the PSC that they are paying for.

After MAVCOM was set up by the Government, there was a marked increase of complaints from the traveling public against the commercial activities and services of airline and airport. It has created an awareness of consumer rights among the travelers, in HERE.

MAVCOM Is A Regulator

MAVCOM is the regulator and it differs from MOT or the Civil Aviation Authority of Malaysia (CAAM). MOT looks into policies while CAAM is a technical regulator, overseeing safety, security and maintenance of the civil aviation sector.

Anyone accusing these entities as overlapping in their responsibilities is either downright stupid or has vested interests. Imagine if MAVCOM were to be abolished, what would that mean to the travelling public? Are Malaysians ready to be duped by certain airline to accept its poor level of service with many hidden charges and poor level of service at the airports?

Clearly from yours truly perspective, we must not allow certain undesirable element with vested agenda, who are in great pains to call for the abolishment of MAVCOM. We, the rakyat, should campaign to give more power to MAVCOM so that the rights of the traveling public are protected at all times – no more hidden charges, misleading advertisement on ticket prices and to ensure orderly development of civil aviation in Malaysia.
