Recalcitrant Platinum Victory slammed with yet another Stop Work Order!

Let’s see what the ‘developers friendly’ Mohd Yusop Alwi of Jabatan Bangunan will do to help.

It’s amazing how Platinum Victory Sdn Bhd continues to blatantly defy DBKL’s building regulations and guidelines even though the company had been issued a Stop Work Order before . Something is definitely amiss and it begs for a clear explanation as to why this developer is so bold and has the audacity to do what it does!

Platinum Victory Sdn Bhd was issued the first Stop Work Order by DBKL on 19 October 2008. However, four days later on 23 October the Stop Work Order was unilaterally lifted by En Mohd Yusop Alwi, the Pengarah of Jabatan Bangunan, under questionable circumstances.

Here’s how En Mohd Yusop Alwi’s single-handed actions had defied all logic. Apparently before the lifting of the first Stop Work Order on 23 October, En Mohd Yusop Alwi saw it fit to have a meeting with Platinum Victory and its architect, the so-called Residents Associations but without the presence of the complainant and I being called.

It seemed the presidents of the so-called Residents Associations had agreed to allow Platinum Victory to work until 11 p.m. and this decision was made without any meeting with the residents themselves. As it happened no one seemed to know about the lifting of the Stop Work Order for a few days until I lodged a complaint with the Datuk Bandar’s office that Platinum Victory was still carrying out construction work despite the Stop Work Order. A day later the Datuk Bandar’s office informed me that it was lifted by En Mohd Yusop Alwi. I protested that I was the person who made the official complaint on behalf of the residents and we were not called for the meeting on 23 October. What was also strange was that the Residents Association never lodged any complaint and they were called for the meeting. This was most unacceptable and I further lodged complaints with YAB Tan Sri Mohd Sidek Hassan, Ketua Setiausaha Negara; Datuk Bandar and the Minister of Wilayah Persekutuan on the suspicious manner with which the Stop Work Order dated 19 October was lifted.

Back to the issue at hand.

On 5 November 2008 I received several complaints that Platinum Victory had started to violate the working hours again by working after 6 p.m. till late at night. I immediately lodged a complaint with the office of Datuk Bandar and Datuk Bandar immediately caused an investigation to be done. When it was confirmed by the DBKL Manager for Wangsa Maju that Platinum Victory was working at 8 p.m. at its Danau Kota worksite, Datuk Bandar’s office then instructed En Mohd Yusop Alwi to issue Stop Work Orders on all of Platinum Victory’s worksites on the night of 5 November.

But here was where a funny thing happened.

En Mohd Yusop Alwi chose only to issue a Stop Work Order for the worksite at Taman Melati Utama. A further complaint was lodged with Datuk Bandar’s Office and it was only after my second complaint that En Mohd Yusop Alwi only then proceeded to issue another Stop Work Order for the Platinum Victory’s Danau Kota worksite.

Man, here was some strange game being played here. What gives?

Given all this shenanigan, I am beginning to wonder what had the “Flying Squads” of Jabatan Bagunan being doing all this while when they were supposed to be working round the clock? I am sure that these so-called Flying Squads must have had been receiving complaints many hundreds of time and yet they were unable to find out that Platinum Victory had been violating the working hours. In fact, it is an open secret that many developers in KL are violating the working hours and some have also worked round the clock with impunity. Why is this happening and what are the forces at play here?

Wouldn’t it be more appropriate then to name the Flying Squads as the “Sleeping Squads?”

I am also wondering what YAB Tan Sri Mohd Sidek Hassan, Ketua Setiausaha Negara and co-chairman of Pemudah, is going to do about the “Developers Friendly” attitude of Jabatan Bangunan.

It is such attitude of the DBKL officers that have made the public lose confidence in DBKL and the government. And it would help for DBKL to remember that they should be ‘Rakyat Friendly’ for there are far more rakyat than developers.

Platinum Victory yang degil kena satu lagi Perintah Henti Kerja!

Sama-sama kita tengok apakah tindakan Mohd Yusop Alwi yang “pemaju mesra” daripada Jabatan Bangunan akan ambil.

Amat menghairankan bagaimana Platinum Victory Sdn Bhd terus tidak menghirau peraturan serta garis panduan pembangunan yang dikeluarkan oleh DBKL walaupun sudah dikenakan Perintah Henti Kerja (PHK). Sesuatu mesti tak kena dan suatu penjelasan mesti diperolehi kerana pemaju ini begitu berani berbuat apa yang disukai sahaja.

Platinum Victory Sdn Bhd telah dikenakan PHK pertama daripada DBKL pada 19 Oktober 2008. Namun 4 hari kemudian, 23 Oktober, PHK ini dibatalkan oleh En Mohd Yusop Alwi iaitu Pengarah Jabatan Bangunan, secara bertindak sendiri dalam keadaan yang mencurigakan.

Inilah tindakan sendirian En Mohd Yusop Alwi’s yang tidak masuk akal. Kononnya sebelum membatalkan PHK, pada 23 Okt 2008, En Mohd Yusop Alwi berpendapat beliau patut mengadakan suatu mesyuarat dengan Platinum Victory dan arkitetnya, dan (kononnya) persatuan pemilik tanpa kehadiran pengadu dan saya.

Nampaknya presiden persatuan pemilik (tak pasti sah atau tidak) telah bersetuju membenarkan Platinum Victory kerja sampai 11 malam dan keputusan ini dibuat tanpa sebarang mesyaurat dengan pemilik lain. Oleh itu tiada orang lain menyedari pembatalan ini sehingga selepas beberapa hari kemudian saya membuat aduan kepada pejabat Datuk Bandar bahawa Platinum Victory masih meneruskan kerja meskipun sudah dikenakan PHK. Sehari kemudian pejabat DB memberitahu saya mengenai pembatalan oleh En Mohd Yusop Alwi. Saya membantah bahawa saya yang membuat aduan rasmi bagi pihak para pemilik dan kami tidak dipanggil untuk menghadiri mesyuarat pada 23 Oktober. Apa yang aneh adalah persatuan pemilik tidak membuat aduan bahawa mereka tidak dipanngil menghadiri mesyuarat. Ini amat tidak boelh diterima dan saya membuat aduan lanjut dengan YAB Tan Sri Mohd Sidek Hassan, Ketua Setiausaha Negara; Datuk Bandar dan Menteri Wilayah Persekutuan mengenai keadaan yang mencurigakan dalam tindakan membatalkan PHK bertarikh 19 Oktober 2008.

Kembali kepada persoalan kini.

Pada 5 November 2008 saya terima lagi beberapa aduan lagi bahawa Platinum Victory melanggar peraturan dan bekerja dari 6 petang sampai larut malam. Saya dengan segera membuat aduan kepada pejabat Datuk Bandar dan beliau memerintah dengan segera bahawa siasatan dibuat. Apabila dikenalpasti oleh Pengurus DBKL untuk Wangsa Maju bahawa masih bekerja pada pukul 8 malam di tapak kerja Danau Kota, Pejabat Datuk Bandar pun mengarahkan En Mohd Yusop Alwi mengeluarkan PHK kepada semua tapak kerja Platinum Victory’ pada malam 5 November.

Tetapi sesuatu yang aneh berlaku.

En Mohd Yusop Alwi hanya mengeluarkan PHK untuk tapak kerja Taman Melati Utama. Aduan lanjut telah dibuat kepada pejabat Datuk Bandar dan selepas aduan kedua saya barulah En Mohd Yusop Alwi mengeluarkan PHK untuk tapak kerja Platinum Victory di Danau Kota.

Apakah cerita sebenar di belakang semua ini?

Dengan keadaan seumpama ini, saya mula fikir apakah yang telah dibuat selama ini oleh “Pasukan Gerakan” (“Flying Squads”) Jabatan Bangunan kerana kononnya mereka patut berkerja tanpa kira masa? Saya pasti pasukan ini mesti menerima banyak aduan namun mereka tidak dapat mengesan bahawa Platinum Victory telah melanggar peraturan waktu kerja. Hakikatnya bukanlah rahsia banyak pemaju di KL melangga peraturan waktu kerja dengan bekerja waktu berlebihan tanpa dikawal. Mengapa ini berlaku dan siapakah dalang di belakang semua ini?

Bukankah lebih berpatutan menamakan Pasukan Gerakan (the Flying Squads) sebagai Pasukan Tidur (the “Sleeping Squads)”?

Saya juga nak tahu apakah YAB Tan Sri Mohd Sidek Hassan, Ketua Setiausaha Negara dan Pengerusi Pemudah, akan berbuat mengenai sikap “Mesra Pemaju” Jabatan Bangunan.

Sikap inilah yang ditunjukkan oleh pegawai DBKL yang menyebabkan khalayak hilang kepercayaan terhadap DBKL dan pihak pentadbiran. DBKL juga harus ingat mereka mesti “Mesra Rakyat” kerana bilangan rakyat jauh melebihi jumlah pemaju.
