It is very interesting to read the seven reasons in the said article. Perhaps YB Tan Sri Nor Mohamad Yacob, the former very powerful Minister of  Finance II under the Badawi’s Administration, Tan Sri Azman Mokhtar, the MD of Khazanah, Tan Sri Md Nor Md Yusof, the then MD of MAS during the famous WAU and the newly crowned Chairman of MAS after the secret share swap, En Mohammed Rahsdan Yusof, co-founder of BinaFikir Sdn Bhd with Tan Sri Azman, Datuk Azman Yahya, the reappointed MAS director of Scomi fame, can learn a thing or two from the said articles. After reading the said article, it is hoped that the abovenamed personalities will see the light and stop the secret share swap and reverse all the recent decisions that were detrimental to MAS/Firefly i.e. cancelation of Firefly’s full load flights during festive season, termination of Firefly’s profitable routes from JB to KK and Kuching, the RM18 sponsorship of home jersey for QPR,  and the most recent termination of MAS profitable route from KLIA to Bandung (Indonesia) and others that have not been exposed. Soalan-soalan versi Bahasa Ingeris di bawah.

1. Tuan Wee Choo Keong [Wangsa Maju] meminta Menteri Kewangan menyatakan:

a. Apakah usaha “due diligence” yang diambil oleh Penerbangan Malaysia Bhd (PMB)/MAS, sebelum memasuki rundingan untuk pajakan tiga buah jet bagi Alwafeer Air (Alwafeer)?

b. Jika kesemua tiga perjanjian pajakan telah dilaksanakan dengan serta-merta dan sekiranya ya,bilakah tarikh bagi perjanjian pajakan tersebut;

c. Sila senaraikan tarikh yang tepat bagi setiap pesawat Jumbo yang diserahkan kepada Alwafeer;

d. Tarikh akhir sewaan yang akan dibayar oleh Alwafeer bagi setiap pesawat dan berapakah jumlah bayaran sewaan yang tertunggak  oleh Alwafeer Air kepada PMB/MAS; dan

e.  Dengan terperinci tindakan yang diambil oleh PMB/MAS bagi memulihkan jumlah hutang sewaan yang masih tertunggak,  iaitu ketika tarikh perlaksanaan tindakan undang-undang untuk pemulihan hutang dan daripada 09.08.2011, apakah status sebenar tindakan undang-undang yang diambil oleh PMB/MAS bagi mendapatkan kembali jumlah hutang tersebut?

2. Tuan Wee Choo Keong [Wangsa Maju] meminta Menteri Kewangan menyatakan:

a. Mengapakah rundingan pertukaran saham di antara MAS-AirAsia dilakukan dalam keadaan kerahsiaan tanpa berunding dengan Kesatuan Pekerja MAS dan pihak-pihak yang berkenaan?

b.  Dengan terperinci mengenai “dur diligence” yang diambil oleh Khazanah sebelum bersetuju dengan pertukaran saham antara MAS dengan AirAsia Bhd, yang mempunyai sejarah hutang sebanyak RM125 juta cukai lapangan terbang kepada  MAHB, dan AirAsia X Sdn Bhd yang merupakan sebuah syarikat swasta dengan kerugian berjumlah RM89.935 juta pada tahun 2009; dan

c. Dengan butir-butir lengkap bagaimana perjanjian tersebut Khazanah bertukar daripada 20.5% bagi MAS pada harga RM1.60 sesaham dan 10% daripada saham Air Asia pada RM3.95 sesaham apabila MAS, sebuah “assets backed corporation” dengan modal berbayar sebanyak RM3.384 bilion dan AirAsia Bhd dengan modal sebanyak RM2.76billion, dan mengapa terdapat satu keperluan untuk Khazanah membeli 10% daripada saham AirAsia X Sdn Bhd, yang secara tidak langsung dimiliki oleh Tan Sri Tony Fernandes & Datuk Kamarudin (kedua-dua AirAsia Bhd) Dato ‘Kalimullah, Lee Kian Onn (kedua-dua ECM Libra)

3. Tuan Wee Choo Keong [Wangsa Maju] minta Menteri Kewangan menyatakan:

a. Sama ada Suruhanjaya Sekuriti (SC) sedar bahawa sebelum penggantungan saham AirAsia Bhd (AA) dan MAS daripada  urusniaga pada 09.08.2011, saham AA telah meningkat naik dari tarikh 20.07.2011 dengan “unprecedented trend” dan seterusnya, namun harga saham bagi MAS menurun dan harga saham AA ditutup pada RM3.95 dan MAS RM1.60 dan apabila penggantungan tersebut harga saham AA menurun dan saham MAS meningkat;

b. Adakah SC menyiasat kemungkinan kesalahan “insider trading” telah dilakukan oleh orang-orang tertentu kerana hanya portal berita Malaysian Insider yang membongkarkan berita tersebut sehari selepas hari terakhir (6-8-2011) untuk urusniaga saham-saham AA/MAS?

4. Tuan Wee Choo Keong [Wangsa Maju] minta Menteri Kewangan menyatakan sama ada ia adalah sebahagian daripada “AirAsia-MAS share swap”:

a. Sama ada Firefly harus membatalkan semua penerbangan semasa Hari Raya baru-baru ini dan juga semua musim perayaan pada masa hadapan mulai sekarang,

b.             bahawa Firefly terpaksa menamatkan perkhidmatan secara kekal dari Johor ke Kuching / KK dari 15.09.2011 atau dari mana-mana destinasi;

c. bahawa Firefly tidak boleh beroperasi destinasi yang sedia atau membangunkan dan/atau mengembangkan operasi atau laluannya selagi dianggap berada dalam persaingan secara langsung atau tidak langsung dengan AirAsia Bhd untuk penerbangan domestik, dan dengan AirAsia X Sdn Bhd (34% ekuitinya dimiliki oleh syarikat-syarikat asing dan 64% dimiliki oleh syarikat-syarikat tempatan di  dana Tan Sri Tony Fernandes dan rakan-rakan perniagaan beliau iaitu, Dato’ Kalimullah, Datuk Kamrudin Meranun, Lee Kian Onn  mempunyai kepentingan secara langsung dengan mereka) bagi penerbangaan antarabangsa?

5. Tuan Wee Choo Keong [Wangsa Maju] meminta Menteri Kewangan untuk  menyatakan:

a. mengapa pada tahun 2003, MAS yang berada di bawah Tan Sri Md Nor Md Yusof, yang pada masa itu merupakan Pengarah Urusan MAS dan juga arkitek bagi Widespread Asset Un-bundling aka “WAU” telah menjual 70% saham daripada bahagian di dalam MAS Catering Sdn Bhd, sebuah syarikat MAS yang “profitable”  dengan purata perolehan tahunan sebanyak RM300 – RM400 juta dan keuntungan bersih sebanyak RM50 juta atau lebih setiap tahun, kepada sebuah syarikat dan serentak dengan itu MAS memasuki suatu perjanjian yang dianggap berat sebelah terhadap MAS dimana MAS terpaksa membeli semua makanan dan minuman serta lain-lain perkhidmatan kabin dengan keuntungan jaminan daripada syarikat tersebut selama 25 tahun;

b. nama syarikat itu dan juga harga jualan serta butir-butir penuh perjanjian selama 25 tahun tersebut;

c. apakah tindakan yang telah diambil oleh Khazanah untuk memecahkan perjanjian yang tidak adil ini yang boleh menjejaskan pertumbuhan MAS dan/atau untuk meringankan beban kewangan MAS?
6. Tuan Wee Choo Keong [Wangsa Maju] meminta Menteri Pengangkutan menyatakan sama ada Kementerian telah memberi kebenaran kepada AirAsia Bhd dan Asia X Sdn Bhd mengenakan bayaran RM8 untuk Yuran Convenience, RM10 untuk kaunter Check-In, RM50 untuk tempat duduk bayi bagi AirAsia dan RM125 untuk AirAsia X Sdn Bhd, RM12 untuk kerusi roda dan lain-lain serta apakah jumlah keseluruhan wang cukai lapangan terbang yang terlibat “no show passenger” bagi kedua-dua syarikat dari tarikh operasi sehingga September 2011 dan sama ada cukai lapangan terbang yang dikutip akan dikembalikan kepada penumpang-penumpang tersebut secara otomatik?

7. Tuan Wee Choo Keong [Wangsa Maju] meminta Perdana Menteri mengenai:

a. Mengapakah En Hasbie Satar, bekas Setiausaha Politik kepada YB Tan Sri Nor Mohamd Yacop, Menteri Kewangan II sebelum ini, tidak didakwa di bawah Akta SPRM kerana rasuah apabila dia ditangkap memiliki beberapa juta wang tunai di Pulau Pinang, beberapa unit kondominium mewah di sekitar negara dan 47 peti besi di rumahnya:

b. berapakah jumlah wang tunai yang ditahan oleh SPRM dan juga nilai bagi setiap kondominium yang telah dibekukan;

c. apakah status semasa wang yang ditahan serta kondominium yang dibekukan?

8. Tuan Wee Choo Keong [Wangsa Maju] meminta Menteri Kewangan menyatakan sama ada Kementerian sedar bahawa “soft loan” berjumlah RM250 juta yang disalurkan kepada Agroscience Sdn Bhd pada tahun 2003 bertujuan untuk mengawal kemasukkan daging halal import telah disalahgunakan dan pembentukan National Feedlot Corp Sdn Bhd yang merupakan sebuah pertubuhan dikawal oleh orang yang sama berada dalam syarikat Agroscience Sdn Bhd dan Real Food Company Sdn Bhd dan apakah status “soft loan” tersebut?

9. Tuan Wee Choo Keong [Wangsa Maju] memohon Kementerian Kewangan
menyatakan:

a. berapakah jumlah wang yang bekas pegawai Kementerian, En Reezal Merican, belanjakan tanpa kuasa dan/atau tidak mengikut prosedur Kementerian yang sediaada?

b. Apakah tindakan yang telah diambil terhadap dia mengenai perbelanjaan yang tidak dibenarkan dan apakah tindakan untuk memperoleh kembali wang yang dibelanjakan tersebut?

10.  Tuan Wee Choo Keong [Wangsa Maju] meminta Perdana Menteri menyatakan:

a. Pada 31 September 2011, berapakah jumlah wang yang telah dibekukan di bawah setiap kategori kesalahan di bawah Akta Anti-Money Laundering (AMLA) dan juga pecahan angka bagi setiap kumpulan etnik iaitu etnik India, Melayu, Cina dan lain-lain;

b.  berapakah jumalah wang yang telah dirampas di bawah AMLA untuk kategori-kategori tersebut di atas;

c.  selain itu, apakah mekanisme yang telah diwujudkan untuk mendapatkan pembelaan di mahkamah, bagi memastikan denda paling minimum bagi AMLA terhadap agensi-agensi penguatkuasaan undang-undang yang lain seperti pasukan polis, imigresen, kastam dan lain-lain?

11. Tuan Wee Choo Keong [Wangsa Maju] meminta Menteri Perumahan dan Kerajaan Tempatan menyatakan bahawa memandangkan kewujudan  kondominium di negara ini yang tumbuh seperti cendawan selepas hujan terutamanya di Bandar-bandar besar khasnya di KL, samada pihak kementerian bercadang untuk meminda Akta “Strata Title” bagi memastikan bahawa peranan dan kuasa Pesuruhjaya Bangunan (COB) yang ditetapkan dan/atau Badan Pengurusan Bersama (JMB) yang telah dipertanggungjawabkan adalah wajar untuk dikenakan denda atau penjara bagi kesalahan yang dilakukan di bawahnya supaya hak-hak pembeli dilindungi daripada pemaju yang tidak bertanggungjawab dan/atau JMB?

12. Tuan Wee Choo Keong [Wangsa Maju] meminta Menteri Penerangan, Komunikasi dan Kebudayaan menyatakan mengapa ASTRO dibenarkan untuk menaikkan kadar langganan tanpa memohon kelulusan daripada pihak Kementerian dan apakah mechanisma dibentuk oleh Kementerian bagi memecahkan monopoli saluran tv berbayar seperti ASTRO untuk program-program seperti National Geography, ESPN, Discovery dan sebagainya?

13. Tuan Wee Choo Keong [Wangsa Maju] memohon Menteri Wilayah Persekutuan dan Kesejahteraan Bandar berapakah jumlah kakitangan DBKL yang terlibat dalam “Cross Fertilisation Programme”, yang dilancarkan oleh YAB PM, bagi tahun 2009, 2010 dan 2011 dan sama ada kerajaan bercadang untuk meminda undang-undang supaya mereka yand terlibat tidak boleh memilih untuk keluar daripada “Cross Fertilisation Programe” tersebut? Jika tidak, mengapa tidak?

14. Tuan Wee Choo Keong [Wangsa Maju] meminta Menteri Hal Ehwal Dalam Negeri mengenai:

a. tindakan yang telah diambil untuk menghentikan penyeludupan manusia yang telah menggunakan Malaysia sebagai negara transit;

b. berapakah jumlah tangkapan yang telah dibuat ke atas ketua-ketua sindiket dan apakah status mereka, iaitu sama ada mereka ini telah didakwa di mahkamah atau belum?

15. Tuan Wee Choo Keong [Wangsa Maju] meminta Menteri Hal Ehwal Dalam Negeri menyatakan:

a. Apakah tindakan positif yang telah diambil oleh kementerian untuk mengawal dan membasmi pendatang tanpa izin yang semakin ramai;

b. Apakah mekanisma yang telah diwujudkan untuk memastikan pelajar asing yang memasuki negara ini di bawah Visa Pelajar adalah pelajar sebenar, terutamanya mereka yang berasal dari Negara Afrika seperti Nigeria dan sebagainya; dan

c. Apakah tindakan yang telah diambil untuk menghentikan serta merta warganegara Singapura daripada menyalahguna Permit Sosial dengan tinggal serta bekerja di Malaysia selama bertahun-tahun?

Questions for written oral answers

1.  Tuan Wee Choo Keong [Wangsa Maju] ask the Minister of Finance to state

a.  Prior to entering into the negotiations to lease 3 aircrafts to Alwafeer Air by Penerbangan Malaysia Bhd (PMB) or MAS, what due diligence exercise have been undertaken by PMB?

b.  Whether all the 3 Leasing Agreements were effectively executed and what was the date of the said Leasing Agreements?

c.  the exact date of each aircraft delivered to Alwafeer Air;

d.  the date of last rental paid by Alwafeer for each aircraft and what is the current total outstanding rentals owed by Alwafeer to PMB/MAS; and

e.  the detailed actions taken by PMB/MAS to recover the said outstanding rental debts i.e. the commencement date of legal actions for recovery of the said debts and as of 9-8-2011 what were the actual status of legal actions taken by PMB/MAS to recover the said debts?

2.  Tuan Wee Choo Keong [Wangsa Maju] ask the Minister of Finance to state

a.  Why was the negotiation on the MAS-AirAsia share swap done in such secrecy and without any consultation with the MAS Employee Union and other stakeholdersb.

b.  Details of the due diligence exercise undertaken by Khazanah before the finalisation of the said share swap on AirAsia Bhd, which has a history of owing RM125 million airport tax to MAHB, and AirAsia X Sdn Bhd, a private limited company with losses totaling RM89.935 million in 2009 alone; and

c.  full details how was the said share swap deal arrived at Khazanah exchanged 20.5% of MAS at RM 1.60 per share for 10% of Air Asia at RM3.95 per share when MAS, an asset backed corporation with paid up capital of RM3.384 billion and AirAsia Bhd RM2.76 billion, and why was there a necessity for Khazanah to buy 10% of AirAsia Sdn Bhd, which is indirectly owned by Tan Sri Tony Fernandes & Datuk Kamarudin (both of AirAsia Bhd)  Dato’ Kalimullah, Lee Kian Onn (both of ECM Libra)

3.   Tuan Wee Choo Keong [Wangsa Maju] ask the Minister of Finance to state

a.  whether the Security Commission (SC) was aware that prior to the suspension of AirAsia Bhd (AA) and MAS from trading share on 7-8-2011 AA share price was on an unprecedented upward trend from 20-07-2011 onward and MAS share price was on a downward trend and AA closed at RM3.95 and MAS RM1.60 and upon lifting the suspension prices of trading on 9-8-2011 AA share went down and MAS share went up; and

b.  did the SC investigate into the possibility of offences committed in connection with insider trading as only Malaysian Insider broke the news one day before the last day of trading (6-8-2011) of MAS/AA, which management are friendly to AA and or AirAsia X Sdn Bhd?

4.   Tuan Wee Choo Keong [Wangsa Maju] ask the Minister of Finance to state whether it was part of the MAS AirAsia share swap agreement

a.  that Firefly must cancel all its flights during Hari Raya Season recently and all future festive seasons from now on,

b.  that Firefly had to permanently terminate all its services from Johor to Kuching/KK from 15-09-2011 or from any other destinations;

c.  that Firefly can not operate its present routes or develop and/or expand its operations or routes as long as such operations or development and/or expansion are considered to be in competition directly or indirectly with AirAsia Bhd for domestic flights, and with AirAsia X Sdn Bhd ( 34% of its equity is owned by foreign companies and 64% owned by local companies where Tan Sri Tony Fernandes and his local business partners namely, Datuk Kalimullah, Datuk Kamrudin Meranun,  Lee Kian Onn have direct interest in them) international flights?

5.  Tuan Wee Choo Keong [Wangsa Maju] ask the Minister of Finance to state

a.   why in 2003 MAS, under Tan Sri Md Nor Md Yusof, the then Managing Director of MAS and architect of the Widespread Asset Un-bundling aka “WAU”, sold 70% of the share of the profit making arm of MAS known as MAS Catering Sdn Bhd, with yearly turnover of RM300 – RM400 million and net profit of about RM50 million or more yearly, to a company, and simultaneously MAS entered into a one sided agreement which MAS to exclusively purchase all food and beverages and other cabin services with guarantee profit for the said company for 25 years;

b.  the name of the company, the selling price and full details of the subsequent 25 year agreement; and

c.  what actions have Khazanah taken to break this unfair agreement that was detrimental to the growth of MAS and/or to lessen the financial burden of MAS?

6. Tuan Wee Choo Keong [Wangsa Maju] ask the Minister of Transport to state whether the Ministry has given AirAsia Bhd and Asia X Sdn Bhd the approval for charging RM8 for Convenience Fees, RM10 for Counter Check-In, RM50 for Infant Seat for AirAsia and RM125 for AirAsia X Sdn Bhd, RM12 for wheelchair and etc and what is the total sum of airport tax involving no show passengers for both companies from the date of its operation at the end of 2011 and whether the airport tax collected should be automatically refunded to the said passengers?

7. Tuan Wee Choo Keong [Wangsa Maju] ask the Prime Minister to state:

a. why En Hasbie Satar, the ex-Political Secretary to YB Tan Sri Nor Mohamed Yacop, the previous Minister of Finance II, was not charged under the MACC Act for corruption when he was arrested with possession of several million of cash money in Penang, 47 safes and several units of luxury condominium;

b. What is the total amount of the total cash money detained by MACC and the value of each of the condominium frozen; and

c. What is the current status of the money detained and the frozen condominiums?

8. Tuan Wee Choo Keong [Wangsa Maju] ask the Minister of Finance to state whether the Ministry is aware that the grant of soft loan totaling RM250 million to Agroscience Sdn Bhd in 2003 to control the import of halal meat has been abused and the formation of the subsequent National Feedlot Corp Sdn Bhd, which is effectively controlled by the same personalities in Agroscience Sdn Bhd and Real Food Company Sdn Bhd and what is the current status of this soft loan?

9. Tuan Wee Choo Keong [Wangsa Maju] ask the Minister of Finance to state:

a.  how much did the ex-officer of Ministry, En Reezal Merican, spent  without authority and/or not following proper existing procedures of the Ministry; and

b.  what actions have been taken against him for the said unauthorised spending and for the recovery of the money spent?

10.    Tuan Wee Choo Keong [Wangsa Maju] ask the Prime Minister to state:

a. As at 31 September 2011 what are the total for each category of offences and amount frozen under the Anti-Money Laundering Act (AMLA) with the breakdown of figure against each ethnic groups of Indian, Chinese, Malay and others and how much have been confiscated under AMLA;

b. what is the amount of money confiscated under AMLA for each category of offences?

c. beside the right to seek redress in court, what are the mechanism  have been put in place to ensure minimum abused of AMLA within the law enforcement agencies like police force, immigration, custom and others?

11.  Tuan Wee Choo Keong [Wangsa Maju] ask the Minister of Housing and Local Government to state in view of the mushrooming of condominiums in the country especially in the big city like KL, does the Ministry intend to amend the Strata Title Act so as to ensure that the roles and powers of the appointed Commissioner of Building (COB) and the responsibilities of the Joint Management Body (JMB) are proper defined and with deterrent fines and/or jail sentences for offences committed thereunder so that the rights of the purchasers are properly protected from the unscrupulous developers and/atau JMB?

12. Tuan Wee Choo Keong [Wangsa Maju] ask the Minister of Information, Multi Media and Culture to state why ASTRO was allowed to increase its subscription fees without the approval from the Ministry and what has the Ministry put in place the mechanism to break the monopoly of paid-tv channel by ASTRO for programs like National Geographical, ESPN, DISCOVERY and etc?

13. Tuan Wee Choo Keong [Wangsa Maju] ask the Minister of Wilayah Persekutuan and Urban Wellbeing to state as at September 2011 what are the total number of the DBKL staff involved in the “Cross Fertilisation Program” launched by the PM and whether the government intends to amend the law so that no DBKL officers cannot opt out from the said Cross Fertilisation Program? If not, why not?

14. Tuan Wee Choo Keong [Wangsa Maju] ask the Minister of Home Affairs to state:

a. what actions have been taken to stop cross borders human trafficking using Malaysia as a transit point:

b. how many arrests have been made against the syndicate leaders and what are the status of the arrest i.e. whether these leaders have been charged in court?

15. Tuan Wee Choo Keong [Wangsa Maju] ask the Minister of Home Affairs to state:

a.  what positive actions have the Ministry taken to control and eradicate widespread illegal immigrants;

b.  what mechanism has been put in place to ensure that foreigners entered into the country using Student Visa are genuine students especially those of African origin like Nigeria and etc; and

c.  what actions have been taken to immediately to stop Singaporeans from abusing their Social Pass by living and working in Malaysia for many years?
