Do we need a code of ethics for judges?

The government just tabled this morning:

“Rang Undang-undang Jawatankuasa Etika Hakim 2008”
(Judges’ Ethics Bill 2008)

Huraian:  Rang Undang-Undang ini bertujuan untuk menubuhkan Jawatankuasa Etika Hakim sebagaimana yang dimaksudkan oleh Fasal (3A) Perkara 125 Perlembangaan Persekutuan bagi mengurusan mana-mana hakim hakim yang telah melakukan suatu pelanggaran mana-mana peruntukan Kod Etika Hakim 2008, jika Ketua Hakim Negara Mahkamah Persekutuan berpendapat bahawa pelanggaran itu tidak mewajarkan hakim itu dirujukan kepada suatu tribunal yang dilantik dibawah Fasal (4) Perkara 125 Perlembagaan Persekutuan.

The explanatory statement for this Bill:  This Bill seeks to establish the Judges’ Code of  Ethics Committee as envisaged by Clause (3A) of Article 125 of the  Federal Constitution to deal with any judge who has committed a breach of any provisions of the Judges’ Code of Ethics 2008, if the Chief Justice is of the opinion that such breach does not warrant the judge being referred to a tribunal appointed under Clause 4 of Article 125 of the Federal Constitution.

Note:

It is a sad day for the country’s judiciary whereby we need a  Judges’ Code of Ethics.  Now we need a Committee headed by the Chief Justice to deal with matters relating to the conduct and discipline of all judges other than the removal of a judge from office pursuant to Clause 3 of Article 125 of the Federal Constitution. We should ask ourselves this pertinent question:  WHY DO WE NEED CODE OF ETHICS FOR JUDGES IN THE FIRST PLACE?   Judges are supposed to be appointed based on their unquestionable integrity.  From my experience, other developed country like UK and the like there is no Code of Ethics for judges and yet the complainants against Judges were minimal.  This supports the public perception that Judges were appointed not based on their integrity but their connections, which is most unhealthy.

Nevertheless, I hope that the Government will seriously think carefully whatever Bill it is tabling concerning the Judiciary as it reflects to the world at large that ALL is not well with our judiciary.  I am really sad over the ill thought out actions by the Government in tabling Bills concerning the judiciary as publicities stance in the hope of creating a legacy for an outgoing Prime Minister.

Adakah kita perlu Kod Etika untuk hakim?

Pihak pentadbiran baru membentangkan ini pagi tadi:

Penjelasan Rang Undang-undang ini: Rang Undang-undang ini ingin menubuhkan Jawatankuasa Peraturan Etika Hakim yang dilafazkan oleh bahagian (3A) Artikle 125 Lembaga Persekutuan mengenai perlanggaran peraturan etika oleh seseorang hakim, jika Ketua Hakim berpendapat hakim tersebut tidak perlu dirujukkan kepada tribunal yang ditubuhkan bawah bahagian 4 of Artickel 125 dalam Perlembaaan Persekutuan.

Nota:

Amat menyedihkan jika kehakiman negara kita memerlukan kod etika untuk para hakim. Kini kita perlu suata jawatankuasa dikepalai oleh Ketua Hakim menguruskan tingkah laku dan disiplin semua hakim jika kesalahan tidak melibatkan hukuman pemecatan menurut bahagian 3 Artikel 125 dalam Lembaga Persekutuan. Soalan nan muncul adalah: MENGAPAKAH KITA PERLU KOD ETIKA INI TERLEBIH DAHULU? Hakim harus dilantik kerana sikap kebenaran dan kejujuran yang tidak boleh dipersoalkan lagi. Daripada pengalaman saya, tiada kod macam ini di negara maju seperti UK kerana aduan terhadap hakim amat jarang. Ini telah memperkuatkan tanggapan umum bahawa hakim kita dilantik bukan kerana sikap kebenaran dan kejujuran tetapi perhubungan mereka, yang memang keadaan yang kurang memuaskan.

Walau bagaimanapun, say aharap pihak pentadbiran berfikir masak-masak semua pembentangan Rang Undang-undang yang berkaitan dengan kehakiman kerana ia akan memberi gambaran kepada dunia mengenai keadaan kehakiman kita yang memang dalam keadaan kurang memuaskan. Saya amat dukacita kerana semua pembentangan Rang Undang-undang yang kurang prihatin ini mengenai kehakiman ini sebenarnya bertujuan semata-mata untuk mencipta suatu warisan yang ditinggalkan oleh Perdana Menteri yang akan letak jawatan tak lama lagi.
