Parliament Questions Time, 29 October, 2009 – V K Lingam Video Clip Scandal Involving Two Former Chief Justices

YB Tuan Wee Choo Keong [WANGSA MAJU] minta Menteri Kementerian Hal Ehwal Dalam Negeri menyatakan perkembangan terkini kerja penyiasatan polis dan SPRM dalam cadangan-cadangan Suruhjaya Diraja akibat skandal video V.K. Lingam dan adakah dakwaan akan diambil terhadap pihak-pihak yang telah “ditangkap” dalam video tersebut?

YB Tuan Wee Choo Keong [WANGSA MAJU] asks the Minister of Home Affairs to state what is the current status of the investigations by the police or MACC into the several recommendations by the Royal Commission on the V.K. Lingam video clip scandal and will there be any prosecutions taken against those exposed in the said video clip?

Saya mengucapkan terima kasih kepada Yang Berhormat Wangsa Maju yang mengemukakan pertanyaan.

Tuan Yang Dipertua,

Untuk makluman Ahli-HAli Yang Berhormat dan Dewan Yang Mulia ini, siasatan berhubung kes video V K Lingam masih dalam siasatan Suruhanjaya Pencegahan Rasuah Malaysia dan pihak polis tidak lagi mengendalikan kes tersebut.

Notes:

1.  Last week a Minister informed Parliament that the investigation on the V K Lingam video clip scandal has been closed due to a material witness could not be found with regards to the Tun Eusoff Chin, the former Chief Justice, and V K Lingam New Zealand trip.

3.  I am shocked that the reply from the Minister of Home Affairs that the police was not longer handling the investigation into the scandal and the MACC is still investigating this matter. The key words used by the Minister of Home Affairs in his reply today are “SIASATAN BERHUBUNG KES VIDEO V.K. LINGAM MASIH DALAM SIASATAN SURUHANJAYA PENCEGAHAN RASUAH MALAYSIA…”

4.  From these two conflicting answers within a matter of two weeks, I do not know whom we, Malaysians, should believe.

5.   Since the Government saw it fit to set up a Royal Commission over this scandal, it is therefore a serious matter which warrant actions to be taken against the culprit.

6.  I would said that the said Royal Commission is the mother of all Royal Commissions and therefore, serious actions have to be taken by the government and Attorney-General  based on its finding and recommendations.

7.   Further, the said Royal Commission Report has made several damning findings and recommendations at:

Para 20.25 : “This kind of misbehaviour is so unprecedented that were it not for the release of the video clip it may never have come to light.”

Para 51:   “…a compelling inference can reasonably and conceivably be drawn that Datuk V K Lingam was actively involved in the appointment of Tun Ahmad Fairuz as President of the   Court of Appeal with the possible aim of his further appointment to the post of Chief Justice of the Federal Court.”

Para 102:  “It is sufficient for us to state here that the collective and cumulative actions of the main characters concerned, had the effect of seriously undermining and eroding the independence and integrity of the judiciary as a whole.”

7.   It must be noted that the whole world has witnessed the proceedings of the Royal Commissions and I am sure everyone in the civilised world were shocked by the revelations of the shocking details during the hearing.  Similarly, it was equally shocking for the civilised world to know of the announcement by the government last week that the investigation into this scandal has been closed.

8.   Now, there seems to be some hope that the Minister of Home Affairs has informed Parliament that the MACC is still investigating into the VK Lingam video clip scandal.

9.  The PM must now come clean to inform Malaysians what is the exact position of the investigations into the V K Lingam video clip scandal.
