MACC & Security Commission Are Investigating Into The Airbus Bribery Scandal of Two Directors of AirAsia!

Yesterday yours truly had posted an article about the bribery scandal involving two AirAsia and AirAsia X executives, HERE.  After several hours of the UK Crown Judgment / Verdict dated 31.1.2020 about the two directors of AirAsia were found to have received bribe of of US$50 million (RM204 million) from Airbus had gone viral, the MACC Chief Ms Latheefa Koya acted expeditiously and announced that MACC was in contact with the Serious Fraud Office (SFO) of UK, HERE.

She should be applauded for taking swift actions in public interest on the said bribery scandal involving the two directors of AirAsia.

Ms Latheefa Koya was right to state in her press statement that:

“Under the MACC Act, we are empowered, and have jurisdiction, to investigate any act of corruption committed by any Malaysian citizen or permanent resident in any place outside Malaysia.”

The AirAsia bribery scandal is not a difficult case for MACC. From a legal stand point, the SFO of UK must already have more than sufficient evidence to prosecute Airbus for bribery based on the evidence it had gathered. Hence, in the light of the evidence,  Airbus was compelled to propose a settlement in order to defer prosecution pending approval from the Crown Court in UK. If Airbus did not enter into the settlement then it will be prosecuted for bribery and etc.

According to to the said Judgment / Verdict the SFO even possessed email correspondence from a director of AirAsia demanding furhter payment of US$4 million. The said email also mentioned that US$16 million had been owed to me for ages when I bought the first 60 aircrafts.

Yesterday yours truly called upon MACC, SC and Burtsa KL to act on the damning evidence exposed in the said Judgment / Verdict of the said Crown Court.

Transparency International Called Upon SC To Act On The Bribery Scandal

This morning Transparency International called upon SC to investigate into the Airbus having paid a bribe of US$50 mil to AirAsia Executive 1 and AirAsias Executive 2 as stated in the said Judgment / Verdict,  HERE.

SC has issued a press statement this morning that it will also  investigate into the said bribery scandal.

“The statement of facts in the case of Regina vs Airbus SE discloses several allegations against AirAsia Group Bhd and AirAsia X Bhd.

“As both are listed on Bursa Malaysia, the Securities Commission Malaysia will examine the allegations and review all available evidence to determine if there is any breach of securities laws,” SC chairman Datuk Syed Zaid Albar said in a statement, HERE.

Yours truly believes that this coming days Bursa KL will also commence its investigation into this bribery scandal.

The Spin Doctors For AirAsia

The spin doctors AirAsia was in great pain in trying to spin out of the very tight corner. But it was a miserable poor attempt, HERE.

It must be noted that in the said Judgment / Verdict Airbus had admitted to have bribed the two top brass of AirAsia and AirAsia X.  The press statement by AirAsia did not touch one single bit about the Agreed Facts in the Judgment / Verdict of the UK Crown Court that Airbus had paid US$50 million (RM204 million) to AirAsia Executive 1 and AirAsia Executive 2!

However, it was very glaring that the spin doctors in AirAsia did not dare to spin on the US$50 million (RM204 million) bribe paid to and received by AirAsia Executive 1 and AirAsian Executive 2.  Why?  It must be that AirAsia knew too well that two of directors in AirAsia had received the RM204 million bribe from Airbus.

We can only feel sorry for the spin doctors in AirAsia was caught in the mess created by the two top brass in AirAsia and AirAsia X.

It is an open and shut case. It will not be too long that the two culprits in AirAsia will be dragged to the Court to be charged with receiving bribe and/or money laundering. Now that SC is also investigating the bribery scandal.

It Is Almost Impossible For AG to NFA The Bribery Scandal

On 9-1-2019 we witnessed the arrest and detention of Dato’ Dr Siew Ka Wei and Elizabeth Ken, the CEO of Geeko Tech Sdn Bhd and media specialist of Redberry Media group, which is an outfit of Siew ka Wei.

It will be almost impossible for AG to NFA (No Further Action) this matter like the scandal costing Tourism Malaysia RM100 million, which involved Dato’ Siew Ka Wei, the executive chairman of Ancom Bhd, and the Redberry Media Specialist, Ms Elizabeth Ken, HERE & HERE.     But we will never know.

Lets sit back and wait for the interesting movie on the Airbus bribery scandal to develop.

MCMC Looted, Shady ‘Speedy Gonzales’ Deal Resurfaces – Part 3 (Siew Ka Wei – Elizabeth Ken Combination Rattles Scandal)

The influential and powerful Ms Elizabeth Ken, the CEO of Geeko Tech Sdn Bhd and Media Specialist of Redberry Media Group, which is a part of the public listed Ancom Bhd‘s Group of Companies.

The combination of Redberry Media Group’s (Redberry) managing director Dato Siew Ka Wei (SiEW) and its media specialist Elizabeth Ken has rattled the burgeoning scandal involving RM340 million to provide free computer tablets to teachers nationwide. SIEW is the current executive chairman of public listed Ancom Bhd and Group MD of Nylex Bhd. Redberry is part of Ancom Bhd’s group of companies. Redberry owned the defunct Malay Mail, whose editor in chief is none other than Datuk Wong Sai Wan.

SIEW’s involvement in meetings between PADU Corporation (PADU)– a company incorporated by guarantee under the purview of the Ministry of Education (MOE) — and Utusan Melayu (Malaysia) Berhad, which was awarded the contract, raises serious questions.

SIEW, the disgraced ex-Tourism Malaysia chairman, sat without a designation as a Utusan Melayu (Malaysia) Berhad representative at a price negotiation meeting on 13 June 2016, HERE.

The Redberry’s media specialist (Ms Elizabeth Ken), signed the Supply, Delivery and Maintenance Agreement between Utusan Melayu and politically connected EPIWEB Sdn Bhd as a witness for the latter on 3 December 2015.

EPIWEB Sdn Bhd’s nature of business is “information technology consultation and related services”.  It would appear that En Khairul Firdaus is not a director of Epiweb Sdn Bhd.

It would also appear from the above that as early as in December 2015, Elizabeth Ken, the media specialist of Redberry, had prior knowledge of the impending tablet project, which was only proposed by the then Minister of Communications and Multimedia, YB Datuk Seri Salleh Syed Keruak, at the end of April 2016.

The contract, without open tender, was for the free supply of 430,000 computer tablets with pre-installed Tutor Guru app and Utusan Malaysia e-paper to teachers by June 2018.

While it is acceptable for anyone to sign as a witness, Ms Elizabeth’s part in the agreement could suggest a lead role taken by her boss SIEW in the project.

Ms Elizabeth Ken is also a signatory in the ‘Speedy Gonzales’ Agreement involving Tourism Malaysia.

Ms Elizabeth Ken signed on behalf of Geeko in the scandalous ‘Speedy Gonzales’ Agreement that involved RM99.693 million of public fund.

The Siew – Elizabeth connection first surfaced in the dubious Tourism Malaysia’s RM99.693 million “Speedy Gonzales-Geeko” tech deal that was done at lightning speed.

Both were arrested and remanded for four days by the Malaysian Anti-Corruption Commission (MACC) in January 2019.  Investigations are continuing.

The tablet project meant to narrow the divide between teachers and students failed miserably due to zero governance, as did the Tourism Malaysia – Geeko Tech Sdn Bhd (GEEKO) scheme, HERE.

Elizabeth was the CEO of GEEKO, a 5-month old company, while Siew was Tourism Malaysia chairman when the deal was evaluated and negotiated. The contract was exchanged and sealed in ONE day on 4 April 2018!

Now that SIEW and Ms Elizabeth Ken have re-emerged into the public eye, we need to know the truth about the tablet deal.

The deafening silence by PADU and Ministry of Education over the issue is shameful.

In fact, all the parties including the Malaysian Communications and Multimedia Commission (MCMC), which channeled the funds to PADU, should take responsibility and come clean.

If we really care about stopping corruption, we should be prepared for whatever may come of investigations. We should not protect shady characters but rather ensure that our trust and confidence are not exploited for the wrong reason.

Little Napoleons’ “Speedy Gonzales” Attempt To Secure Promotion Of Datuk Musa Foiled

The Tourism Malaysia (TM) Board of Directors has foiled an attempt by the ‘Little Napoleons’ in TM to use an old letter of clearance or good character by the Malaysia Anti-Corruption Commission (MACC) to support the promotion of Datuk Musa  Bin Yusuf as Director General (DG) of TM.

The ‘Little Napoleons’ in Human Resources Department of TM (HR) head by its Director, Puan Rafidah Idris (Rafidah) and her deputy Tuan Ahmad Johanif Bin Mohd Ali (Ahmad Johanif) have been ordered to get a fresh letter of clearance or good character on Datuk Musa Bin Yusuf from MACC.

KSU Of MOTAC & KSN To Take Actions

Just to digress a little, Ahmad Johanif is free to support whichever party he wants but as a civil servant he must be neutral.  As a civil servant, he is governed by the General Orders, HERE. The KSU of MOTAC and KSN should look into the conduct of Ahmad Johanif during the 14 GE and the only few postings in his Facebook reproduced above. There are more negative postings of PH government and YAB Tun Dr  Mahathir!

TM’s Board Meeting of 25 March 2019

On 25 March 2019, the Board of Directors was presented with the papers to recommend or support the promotion of Datuk Musa Bin Yusuf to the rank of Jusa B as a prelude to confirm him as the Director General of TM.  The HR headed by Rafidah and Ahmad Johanif included amongst other documents there was a one year old letter of clearance or good character of Datuk Musa Yusuf from MACC to support his promotion.

Both of them knew or ought to have known that the standard procedure for proposing an officer for high ranking promotion in TM must be supported by current letter of clearance or good character from MACC.  Yet these two Little Napoleons saw it fit to knowingly overlook this elementary procedure for special reason best known to two of them.

By the way the ‘Little Napoleons’  Raffish was recently promoted as Director of HR and Ahmad Johanif was recently transferred to be her deputy after the “Speedy Gonzales” elevation of Datuk Musa Bin Yusuf as the DG of TM, HERE.

The Scandalous ‘Speedy Gonzales” RM99.693 Million

If these two ‘Little Napoleons’ were to carry out their duties diligently, they would have known that TM is currently burdened with the scandalous “Speedy Gonzales” RM99.673 million Geeko Tech Sdn Bhd’s (GEEKO) deal, HERE. They knew in mid January 2019 from the massive publicities generated by the arrest and remand of Dato’ Dr Siew Ka Wei, who at the material time when the said scandalous deal was struck on 4 April 2018 was the chairman of TM, and Ms Elizabeth Ken Tzu Ying by MACC for four days, HERE.

Dato’ Dr Siew Ka Wei is the former chairman of TM and current executive chairman of Ancom Bhd, MD of Nylex Bhd and MD of Redberry Media Group (Redberry).  Dato’ Dr Siew Ka Wei is also the directors of many outfits namely, Meru Utama Sdn Bhd (awarded with 10 years exclusive advertising space contract in KLIA), Titanium Compass Sdn Bhd (awarded with exclusively 10 years advertising space contract in MRT stations) and others. These two ‘Little Napoleons” Rafidah and Ahmad Johanif were apparently suffering from very severe wilful blindness when the proposal papers were prepared to support the promotion of Datuk Musa Bin Yusuf for the Board of Directors of TM for approval.  They knowingly omitted to present the glaring facts below with the predominant purpose to deceive or at best mislead the Board of Directors of TM into approving the promotion of Datuk Musa Bin Yusuf.

These two ‘Little Napoleons” should be suspended and face disciplinary actions for serious misconducts for knowingly presented the outdated MACC letter of clearance for Datuk Musa Bin Yusuf.

The Glaring Facts

  • When Geeko Tech Sdn Bhd (GEEKO) was incorporated on 6 November 2017 and Koperasi Kakitanggan Kementerian Pelancongan Kebudayaan Malaysia Bhd (also known as KOPEMA) was one of its shareholder holding 10,000 shares, HERE;
  • Datuk Musa Bin Yusuf is the President of KOPEMA;
  • The Datuk Musa Bin Yusuf‘s infamous “Promos Bersama” of 19 January 2018;

  • On 19 January 2018 Datuk Musa Bin Yusuf, the then Director of International Promotion (Africa/China) submitted a proposal known as “Promosi Bersama Dengan Tourism Malaysia Dan Tencent/Geeko Bagi Promosi Pemasaran Digital (Smart Tourism)” (“Promosi Bersama”) cost TM a whooping RM1,167,900.00, to the then DG of TM, Datuk Seri Mirza Bin Mohamed Taiyab (Datuk Seri Mirza).  Please read HERE  & HERE
  • The said Infamous “Promos Bersama”, of course, approved in lighting speed by the then DG of TM, Datuk Seri Mirza.
  • TM paid Geeko RM1,167,900.00 in lightning speed for the so-called “Promosi Bersama”, which Datuk Musa’s Bin Yusuf told the press that he was not aware of and he had instructed his officers to look into the matter, HERE & HERE;
  • Until now there no news of Datuk Musa Bin Yusuf’s investigation into his  Infamous “Promosi Bersama” that cost TM RM1,167,900.00;
  • Prior to the so-called “Promosi Bersama” of Datuk Musa Bin Yusuf, TM was already trying to appoint Deloitte Singapore and/or Deloitte Malaysia to conduct a ‘kajian” on the similar subject of digital marketing.  However, the appointment did not materialise.

The infamous “Promosi Bersama” was not a joint promotion but in reality it was a scheme devised to appoint GEEKO to prepare a so-called “kajian” to pave the way for TM to enter into the scandalous “Speedy Gonzales” RM99.693 million contract with GEEKO, which deal was evaluated, negotiated and agreement was prepared and executed in one day on 4 April 2018.

Luckily the Board of Director spotted the glaring flaw in the supporting documents to promote Datuk Musa Yusuf i.e. the outdated letter of clearance or good character of him from MACC.  However, the Board approved the proposal in principle subject to the submission of a current dated letter of clearance or good character from MACC for Datuk Musa Yusuf and to be approved by KSN.

MACC should go deeper into the scandalous “Speedy Gonzales” GEEKO RM99.693 million deal by digging into the KOPEMA shareholding in GEEKO and said infamous “Promosi Bersama” by Datuk Musa Bin Yusuf.
