Updates at 2:45 pm 13-3-2013: Yesterday seven complainants from Danau Kota Flats were called to Kepong Police Station (IPD) Commercial Crime Department for their statements to be recorded. They have given their statements and provided all the documents requested by the investigation officer. Below is the picture of the complainants waiting for their statements to be recorded. They have been told that the Commercial Crime Department has commenced its investigation and Mr David Lim Kok Chu, Mr Tan Kee Seng, other directors and the staffs of Danau Kota Management Services Sdn Bhd will also be called to give their statements on this scandal.
On 9-3-2013 yours truly and several owners of Danau Kota Flats held a press conference in Block C to highlight the concerns of the Danau kota Flats owners on the huge unpaid bills of TNB and Syabas totaled RM674, 009.35 owed by Danau Kota Management Service Sdn Bhd (Danau Kota Management).
Mr David Lim Kok Chu’s relationship with the self-professed ‘winnable candidate”
Although Mr David Lim Kok Chu is not a director or shareholder of Danau Kota Management, he has full control in the management of the finances of Danau Kota Management and Danau Kota Flats. It is an open secret that he is closely connected to Datuk Yew Teong Look, the self-professed MCA’s “winnable candidate” for Wangsa Maju. This MCA’s “winnable candidate” has been working extremely hard to paint a rosy picture that he is the “winnable candidate” over Datuk Shafee Abdullah, the BN Chairman for Wangsa Maju. This self-professed MCA’s winnable candidate has been campaigning very hard against the said BN chairman for Wangsa Maju
To prop up his status to be the “winnable candidate”, Datuk Yew Teong Look saw it fit to brag within the MCA circle and the Chinese community that despite the heavy schedule the YAB PM Datuk Seri Najib had made time to see him recently but he stopped short of stating that he has been officially endorsed as the “winnable candidate”. The said meeting was now an open secret within the Chinese community.
A desperate man engaging in desperate measures. His fight to be the “winnable candidate” will be more intense a the 13th GE is drawing nearer. We will no doubt be witnessing more activities similar to the setting up of the so-called “Coalition of 120 NGOs” or dinners functions organised by this self-professed “winnable candidate” Datuk yew Teong Look which was only endorsed by none there than his Ong Ka Ting‘s faction mate, YB Liow Tiong Lai, the Minister of Health, who is also equally “winnable”.
The setting up of the so-called “Coalition of 120 NGOs”
To achieve the political attention to his self professed status of “winnable candidate”, Datuk Yew Teong Look went as far as to set up a so-called “Coalition of 120 NGOs” of which 73 were unregistered societies and the decision of the remaining NGOs to join the so-called coalition was questionable because there were no meeting held to commit its “loyalty” to this MCA’s “winnable candidate”. To understand the whole picture, it will be necessary to identify the connection of the office bearers of this so called coalition of NGOs and the MCA’s “winnable candidate”. Mr David Lim Kok Chu is one of the important office bearers of this so-called coalition and also a chairman of the unregistered “JMB of Danau Kota Flats parcel 2 JMB”. He is also the key man in Danau Kota Management. It was a clear case of conflict of interest. A detail relationship of the office bearers of the so-called coalition will be in the next posting.
Danau Kota Flats with no Strata Title
Danau Kota Flats has been classified as low cost and many owners were not well-informed. The Danau Kota Flats have been sold and occupied for almost 10 years and no Strata Titles have been applied for. The MCA’s “winnable candidate” did not touch on this issue or any issue adverse to the Danau Kota Management. However, he has been busy with all kinds of activities to shore up his status as the “winnable candidates”.
The above digression was necessary to understand the background and why Danau Kota Management was installed as the management of Danau Kota Flats. It is the normal practice that when Joint Management Body (JMB) was formed for flats/apartments under the law, the the management company will be subject to the control of JMB and the accounts on the collections of maintenance charges and sinking will be scrutinized by JMB and the JMB will provide an audited accounts for the flats/apartments at its annual meeting. This is not the case for Danau Kota Flats.
Attempt to disrupt the press conference
Until this date, the Danau Kota Management never provided the audited accounts of Danau Kota Flats to the JMBs or the owners.
- After the said press conference commenced for just a few minutes, there was an interruption from one of the owners of Danau Kota Flat who is popularly known as “Pendek Lim”, who is also Mr David Lim Kok Chu’s close friend and business partner.
To everyone surprise including the reporters, Pendek Lim announced that the police report of Ms Indira against the Mr David Lim Kok Chu and the Danau Kota Management has been withdrawn. Pendek Lim as though he is well connected to the officer of Commercial Crime and/or Setapak Police station. Those present knew Pendek Lim was trying to divert attention and to give an impression that there was no longer a police report against Mr David Lim Kok Chu and Danau Kota Management. It was “party time” again for all concerned.
When yours truly told him that this was the press conference arranged by the other owners and yours truly and that another eight Danau Kota Flats’ owners have lodged similar reports against Mr David Lim Kok Chu and Danau Kota Management, Pendek Lim went into a state of shock and total silence thereafter.
It was quite clear that he was sent by someone to do damage control and disrupt the said press conference for Mr David Lim Kok Chu and/or Danau Kota Management. It was not difficult to conclude that who sent this Pendek Lim to the dirty work at the said press conference.
Yours truly has contacted the Commercial Crime Department yesterday, an appointment has been fixed for today for all the eight owners’ statements to be recorded.
Complaint lodged with TNB
Yours truly has lodged a complaint with a high ranking officer of TNB with regards to the said total debt of RM483, 389.50 incurred by Danau Kota Management. It was agreed that a thorough investigations into the ways in which the total debt was allowed to be dragged on for so many years which was detrimental to the interests of the 1,914 owners of Danau Kota Flats.
Mr David Lim Kok Chu and/or Danau Kota Management must fully pay up all debts incurred with TNB and Syabas as they have collected more than RM5 millions for maintenance charges and RM515,000 Sinking Fund over the years.
After the said press conference, it was decided by the owners to go the office of Danau Kota Management in Block A to ask about the outstanding debts with TNB and Syabas, and the accounts and most of all the balance of Sinking Fund, which belongs to the owners.
When we asked the two members of staff of Danau Kota Management, there could not provide answers accept to say that Mr David Lim Kok Chu was the person fully in charge of the accounts and operations of Danau Kota management. The account staff has made several calls to Mr David Lim Kok Chu but he didn’t answer the calls.
Thereafter, a Malay man identifying himself to be the chairman of Persatuan penduduk Danau Kota Flats came in to “assist”. This Malay man was seen moving around together with “Pendek Lim” who has earlier tried to disrupt the press conference.
The other owners ignore him and demanded to know about the debts to TNB and Syabas, and for the accounts for all the years that Danau Kota Management have been collecting the maintenance charges and Sinking Fund. The two members of staffs were unable to confirm whether there is any balance in the Sinking Fund account, which is most shocking.
Mr Tan Seng Kee, the former taxi driver, the director, shareholder and “kernai” of Danau Kota Management Sdn Bhd
Suddenly, a Chinese man rushed into the office and he appeared very disturb. When he was asked, he identified himself as one of the “KERANI” (clerk) of Danau Kota Management and his name is MR TAN SENG KEE. He confirmed that he is a director and shareholder of Danau Kota Management but with very share in it.
When he was pressed for answers and the outstanding audited accounts, he said that he is just a small shareholder and director with no power. Yours truly has been informed that he was a taxi driver before he was roped into Danau Kota Management and that he has been used by Mr David Lim Kok Chu as the hatchet man in Danau Kota.
Questions have been raised by the owners about excessive water charges and/or water meters may have been tempered with
Mr Tan Kee Seng has been informed that water meters for each unit of Danau Kota Flats has been installed by Danau Kota Management themselves and it will bill the owners for the water supply. When he was asked whether the water meters have been properly calibrated by the Ministry of Domestic Trade and Consumer Affairs before the installation, he could not answer and reasserted that he was just a small “kerani” (clerk) in the company and he had to clock in daily.
The owners have complained that their water meters reading are erratic and they suspect that the water meters have been tempered with. Further, they have not been given a detailed water bill accept for the total sum to be paid to Danau Kota Management. The owners have requested yours truly to lodge a formal complaint to the said Ministry and Syabas for a full investigations the water meters were tempered with and charges for water supply was excessive or well above the rate permitted by Syaba.
