The Stop Work Order for KP Property Sdn Bhd.

[Update 15-7-2011:  Tuan Rohaizan bin Ahmad, the Pengarah for Jabatan Bangunan, has been suspended and/or disciplinary actions have been taken against him for violating DBKL policy/regulations for granting extension of time until 8:30 pm or later without getting approval from Datuk Bandar Kuala Lumpur.  

Under DBKL policy and regulation, the permitted working hours from Monday to Saturday are from 8:00 pm until 6 pm for good reason.  To ensure that the construction site will not cause public nuisance to the residents.  

I am informed that he is no longer the Pengarah of Jabatan Bangunan and the officers of the Flying Squad under him have all been changed.  Most probably, they were actually “sleeping on the job”.  I am also told that Tuan Rohaizan is very “contractor friendly’.

I am now informed that all application for extension of time by contractor had to be consider by the One Stop Center Committee. The new Pengarah for Jabatan Bangunan has no opportunity to be “contractor friendly”. Thanks to Yg Bhg Tan Sri Ahmad Fuad bin Ismail, Datuk Bandar Kuala Lumpur. ]

This is the Stop Work Order issued to KP Property Sdn Bhd for the construction site for the 27 storey condominium in Diamond Square, Wangsa Maju. This recalcitrant contractor has been working until late night with immunity.  The residents nearby have lodged many reports with DBKL Call Centre and the Jabatan Bangunan did not take any action. Well, Jabatan Bangunan is very “contractor friendly”! Why?

The Stop Work Order was only issued when this matter was brought in Parliament with regards to the attitude of the officers in DBKL, HERE.  This Stop Work Order came as a relief to the residents of the Diamond Square area where they have been suffering from this recalcitrant contractor.

I hope that the other contractors in Wilayah Persekutuan will take heed of this matter and upheld their social responsibility to the residents of the area. More importantly, I do hope that DBKL Flying Squad will now wake up from their sleep and monitor building site.

Last but not least, DBKL Jabatan Perancang Bandar had to explain how could the approval be given for this project when it is so near (less than 100 feet apart) to adjoining condominium.  A letter has been sent to the Jabatan Perancang Bandar and I am still waiting for its reply.

On behalf of the Diamond Square residents I would like to take this opportunity to say Thank You to Yg Bhg Tan Sri Ahmad Fuad Ismail for his intervention which has resulted in the issuance of this Stop Work Order.

    Salah maksud isi kandungan surat tersebut. Mana boleh arah “Memberhentikan Kerja-Kerja Pembinaan di tapak bina”. Sepatutnya kata “tidak dibenarkan menjalankan kerja-kerja pembinaan diluar masa kerja yang dibenarkan”. Boleh saman DBKL nie.

    I am a resident around the area in Diamond Square Wangsa Maju.

    I am aware that many complaints have been lodged with DBKL Call Centre about KP Property but the DBKL officers “tidak peduli” at all. We knew why no actions taken. I still remember YB has once said that DBKL officer are “contractors friendly”. They just don’t care about the people.

    Thank you for speaking up for us in Parliament and hopefully this will wake up the officers especially the “Sleeping Squad”!

    Very correct that DBKL officers are very Contractor Freely. That’s why KL Residents are facing all these problems.

    I hope that the Datuk Bandar will look into this problem: too much minum kopi!

    I also hope that the Stop Work Order will remain for a few months so that the officers and the contractor can understand about the DBKL policy and regulations.

    In the first place this project is not in Wangsa Maju (As shown in Paragraph 1). It is In Daerah Mukim Setapak.

      Thank you for your comment and I do appreciate it.

      Please be informed that you are correct that the site in question is in Mukim of Setapak but it is in the Wangsa Maju Parliamentary Constituency. There are many properties located in
      certain Mukim, which name is totally different from the name of the Parliamentary Constituency. So i do hope that you will not be confused or misled by the name of the Mukim.

      However, in whatever constituency the construction works must not disturb the quiet enjoyment of the rakyat when they are resting after a hard day work especially late in the night and public holidays.

    there is another construction nearby not only KP… they started work at 7am!!!!!!! super noisy!!! but they are not being order to stop work!!!!!! even this morning, they started their ding ding dong dong work as earlier as 7am!!!!! pls help!!!

    What about the owner of the named properties?
    They are rakyat as well, they need rest after hard day work and with the stop work order, I believe most of them will had restless sleep.

    To be fair for Diamond resident, 1 month stop work order is enough to punish the developer. Stop their work again if the developer still work above the time.

    Human cannot make everybody happy and the right decision may not be the fair decision.

    Terima kasih atas aduan dan maklumat Sdr.

    Merujuk kepada aduan Sdr, pihak kami telah membuat aduan ke Call Center DBKL mengenai aduan kontraktor di Green Setapak Kondo yang menjalankan kerja-kerja binaan lebih awal dari masa yang dibenarkan beroperasi. No repot adalah 037223 yang baru kami terima walaupun aduan telah kami buat pada 16.07.2011 atas alasan komputer tidak boleh digunakan.

    Pihak kami juga telah menulis surat rasmi kepada Jabatan Bangunan memaklumkan berkenaan aduan Sdr supaya tindakan dapat diambil terhadap kontraktor berkenaan.

    Nampaknya setelah begitu banyak aduan-aduan yang melibatkan kerja lebih masa dibuat oleh orang awam, pihak kontraktor telah mengubah cara mereka berkerja dengan memulakan kerja-kerja mereka lebih awal dari masa yang dibenarkan oleh pihak DBKL.

    Pihak kami akan memaklumkan kepada Sdr sekiranya mendapat jawapan dari pihak DBKL dan sekiranya pihak Sdr perlukan satu salinan surat tersebut boleh menghubungi saya di no. 41433322.

    I believe all 222 owners want to know when the project resume, at least given a date. The stop work has been 1 month.

      Thank you for your comments.

      It is noted that the Stop Work Order is in operation for almost a month. Please be informed that the developer has apologised to the residents for working after the permitted hours by DBKL. I was given copies of the special permits for the developer to work until 8:30 pm, which was approved by the then Pengarah, Tuan Rohaizan and I believed that he has been suspended.

      I do sympahtise with the purchasers of the condominium as the Stop Work Order will no doubt cause delay to the completion of the condominium.

      For all intents and purposes, a Stop Work Order lasting for a month is a sufficient lesson to the developer. As long as the developer kept to their undertaking to operate within the stipulated hours, I believe that no one should have any objection for them to resume operations.

    I am purchaser of 222 residensi went to look at project site and gate locked and saw no activity. Contractor staff said area block resident complained and that is why work stop for 4 weeks. Still don’t know when start back.

    Read the blog site now and YB I worried about my unit purchase and bank loan. Please can you help solve the problem and re-start. When can this happen and authority allow back to go on normal.

    But i setapak green is still working today!! I thought they are not suppose to work on Sunday!!! why should DBKL practice double standard! I can still hear the noise from the construction on Sunday early morning!!
