25-10-2010 Questions Time: AirAsia

Tuan Wee Choo Keong (Wangsa Maju) minta MENTERI PENGANGKUTAN menyatakan kedudukan pembayaran cukai lapangan terbang AirAsia dan oleh sebab banyak perkhidmatan tembang murah di kebanyakan Negara telah ‘’bankrupt’’ termasuk di Amerka Syarikat, India dan baru-baru ini di Hong Kong yang melibatkan ‘Oasis’. Apakah langkah yang diambil untuk menjamin pengguna yang telah membeli tiket AirAsia lebih awal akan berlepas dan tiba pada tarikh dan waktu sebagaimana yang ditetapkan.

JAWAPAN:

Tuan Yang Dipertua,

 

Untuk makluman Ahli Yang Berhormat Wangsa Maju, setakat bulan September 2010, AirAsia tiada hutang tertunggak dengan Malaysia Airports Holding Berhad (MAHB).

 

Berhubung persoalan langkah yang diambil untuk menjamin pengguna yang telah membeli tiket AirAsia lebih awal akan berlepas dan tiba pada tarikh dan waktu sebagaimana yang ditetapkan, adalah dimaklumkan bahawa sehingga kini tiada sebarang Negara yang mempunyai mekanisme khusus bagi memberi jaminan bagi semua advance booking tiket penerbangan yang dilakukan oleh penumpang.

 

Sungguhpun begitu, antara langkah yang diambil oleh AirAsia bagi memastikan hak penumpang yang telah membeli advanced booking tiket  adalah seperti berikut:

 

(i) Semua penumpang yang telah membeli tiket penerbangan AirAsia akan menjadi creditor bagi syarikat AirAsia sama seperti pembekal perkhidmatan kepada AirAsia yang lain;

 

(ii) Sekiranya penumpang membeli tiket penerbangan melalui kad kredit, mereka adalah dilindungi oleh pihak bank pemberi kredit tersebut;

 

(iii) Penumpang diberi opsyen untuk mendapatkan insurans perjalanan bagi jaminan untuk sebarang kemungkinan; dan

 

(iv) Sekiranya AirAsia berhadapan dengan kemungkinan situasi muflis, semua aset AirAsia akan dibekukan dan akan ditadbir oleh pemegang amanah yang dilantik. Dalam hubungan ini, penumpang boleh mengemukakan tuntutan pengembalian wang harga tiket daripada pemegang amanah ini.

 

Note:

  1. Answer (i)  of course all the persons who bought the AirAsia ticket are the creditors when it collapsed.  The obvious problem is when a company collapsed it must be due its was unable to meet its liabilities. Under such situation what the point of being a creditor.

 

  1. Answer No: (ii)  when one purchased something using a credit card the card issuer would have paid the merchant i.e. AiraAsia and how on earth the card issuer will protect the card holder when the merchant collapsed.

 

  1. Answer no: (iii)  I do not know of such insurance scheme provided by AirAsia or other online companies.  Further, why should the passengers purchase an insurance cover for this.

 

  1. Answer No. (iv)  of course when AirAsia is wound up or collapsed all its assets will be frozen under the Company Act. What is the point its liabilities will exceed its assets. The purchasers of AirAsia tickets will just be victims.

The Ministry was not performing its duty by giving such stupid answers. It is not protecting the interests of the consumers. By right the Ministry must enforce a scheme or regulation that AirAsia can only utilize the money it collected from online purchase one month before the flights or AirAsia secure a bank guarantee for all tickets purchased online. These are the only ways that the consumers can be protected.  I shall press the Ministry to do their job properly during the committee stage of the Budget 2011 debate.

    i am equally concerned about AirAsia. I am told that its flights always delayed.

    AirAsia is a very rich company buying 150 airbus. Fantastic! My question is: Where is the funding coming from? looking at their account I doubt if they can the 150 airbuses. Previously AirAsia cannot pay the airport taxes that it has collected in advance and MAHB had to give them discount.

    YB satu perkara yang paling meragukan ADALAH KENAPA AIRASIA DI BERI DISKAUN BAYARAN CUKAI LAPANGAN TERBANG SEDANGKAN CUKAI TERSEBUT DIBAYAR OLEH PEMBELI TIKET??

    Ini adalah jelas satu PENIPUAN .. dan MAB BERHAD perlu menjawab..kerana jika AIRASIA diberi DISKAUN DIATAS PEMBAYARAN CUKAI LAPANGAN TERBANG MAKA PEMBELI TIKET PERLU DI BAYAR BALIK CUKAI YANG TELAH DIBAYAR..

    con fly, Where is the funding coming from? Good question. I will give you a clue. Lets say, I have RM 500 millions from a disputable source and I cannot park my money anywhere obvious.
    Air Asia is the next best place, where Everyone in high places can fly and be your friends.
