Medan Idaman Sdn Bhd is the developer of Idaman Sutera Condo, Medan Idaman.  The Joint Management Body (JMB) of Medan Sutera Condo has been requesting for the rectification works to done by the developer to the sewage piping, which was not in accordance to specifications, how one unit of condo owned by the developer has 153 car parks and various other matters. The JMB has also been requesting the developer to handover the balance of the sinking fund but so far no respond.

The developer saw it fit to fix an AGM to form the Management Corporation on 24-10-2010 despite strong objections from the JMB.  The AGM was convened by representatives of a property agent, which was appointed by the developer. But no representative of the developer was present to answer questions from the residents.  Under the Strata Title Act, the developer must be present to convene the AGM. The residents and I objected to the AGM. There was no enough quorum for the AGM.

Th representative of the property agent had no alternative but accept that today meeting cannot constitute as the first AGM because of non compliance with the Strata Title Act i.e. non attendance of the developer.

Several squatters who were living on the land before the construction of Idaman Sutera were also present to demand that the developer to fulfill its promise to give them low cost houses after the construction of the said condo. It is hoped that the developer will fulfill its promise to the squatters before the next AGM failing which the squatters may proceed to the developer’s office for further actions.

Pihak pemaju rasa ia adalah munasabah untuk menetapkan 24-10-2010 satu Mesyuarat Agung Tahunan yang pertama meskipun terdapat bantahan kuat dari Badan Pengurusan Bersama (JMB). Mesyuarat ini dikumpul oleh wakil agensi hartanah, yang di lantik oleh pemaju. Tetapi tiada wakil daripada pihak pemaju yang hadir untuk menjawab soalan dari penghuni-penghuni. Dibawah Akta Hakmilik Strata, pemaju mesti hadir untuk mengadakan AgM ini. Penghuni-penghuni dan saya membangkang mesyuarat tersebut. Selain itu, korum adalah tidak mencukupi untuk mengadakan AGM.
Perwakilan dari agensi hartanah tidak mempunyai sebarang alternatif selain dari menerima hakikat bahawa mesyuarat pada hari ini tidak dapat diadakan kerana mesyuarat Agung Tahunan yang pertama ini tidak memenuhi syarat dibawah Akta Hakmilik Strata iaitu ketidakhadiran pemaju.
Beberapa penghuni liar yang pernah mendiami di atas tanah sebelum pembangunan Idaman Sutera juga hadir untuk menuntut balik perjanjian yang telah dibuat sebelum ini iaitu menyediakan perumahan kos rendah kepada mereka setelah siap pembangunan kondo tersebut. Mereka berharap pemaju akan mengotakan perjanjian sebelum Mesyuarat AGM,jika tiada jawapan dari pihak pemaju, tindakan seterusnya akan diambil ke pejabat pemaju

    Thanks for the posting.
    I am surprised to note that the similar problem we residents and owners are facing in Putra Villa condo at Taman Melati. developer Haluan Mulia is owning so many Car Parks in our place .
    They also used JMCB as their puppet and deceive all the residents by fixing 16 October,2010. We questioned them and eventually the whole committee resigned. Leaving the whole community in limbo. They also deceived Muslim owners a rightful demand for a surau for Muslims to pray. If anyone ask explanation the representative uses a threat to residents to see you in court.
    I am also told there are many issues underneath not known to residents and poor residents will eventually face the music for repairing at heavy cost in future.
    Tiles in the houses and other public places are already breaking and Haluan Mulia refused to repair that our period for agreement is finished.
    Wish someone listen us.

    As to date we all have given up any hopes on the COB.The Act 663 with the COB monitoring it is just a waste of the rakyats money.We never see in the news papers or even the local media the COB have accomplish anything for the Condo and apartment owners till today.

    We have been cheated for 2 years after the formation of JMB.A lot of our official complains about the building defects ie water ponding,over flow of man hole which causes all the ground floor units toilet bowls to be clogged to COB was not answered at all. When the developer conducted the formation of JMB 2 years back we notice no monitoring/checking of maintenance fees paid up to date was done and the accounts was not table at all.We took over this building with almost everything were not in working order ie fire fighting equipment,water pump,swimming pool pump,electrical room was not maintain at all, our stand by gen set can’t even auto run at all and the batteries were totally dead.We have to seek your help almost every month to get our funds back from the heartless developer for maintaining our condemn building.The developer’s rep. has only attended our meetings for only two sittings.After 2 years the developer is still holding more than 80k and we have to suffer everyday living in our so called condo by facing various break down problems.

    YB Wee we were very thank full and glad for the helped you have given us in this matter.Should you have not help us I think we have gone bankrupt in just 6 months after the formation of the JMB.

    To Khaliq Ahmad of Putra Villa Condo,

    Someone told me about your post on putra villa and after reading it, I just had to make sure I must correct your statements on our MP’s blog.

    You are either making up stories or you are covering up the truth / defending someone involved.

    (i) JMC deceived owners by resigning
    My cousin owns a unit at this condo, and what happenend on 16th Oct was not as what you claimed, it seemed that a group of irresponsible owners bashed and humiliated the JMC during the beginning as they were not willing to accept the procedures of the voters set in the act. These people then let outsiders into the meeting hall to halt the AGM.

    (ii) Deceived owners on surau
    And the same goes to your claim on them deceiving owners on a surau. After the JMC resigned, a certain group of people continued to use a big space in the club house and named it officially a surau. We don’t know if there’s any approval on this arrangment. We even saw banners outside the condo guard house on different occasions, inviting others to join activities held in this so-called surau in the condo.

    We don’t know who is in-charge now after the JMC resigned, but it looks like you have made another false statement again!

    If you want to improve the condo and demand improvements from the developer, you should really demand it from whoever that is in-charged now, rather than posting false and misleading statements here!
