Credit Card loss and your RM250 liability. Also, why is Bank Negara failing to act?

Kehilangan kad kredit dan tanggungan anda setakat RM250 sahaja. Mengapakah Bank Negara gagal ambil tindakan yang sepatutnya?

I would like to congratulate the learned Justice YA Datuk Mohamed Apandi Ali for holding that Bank Negara Guidelines on Credit Cards issued to all such companies in Malaysia “had the force of law.” He also held that the guidelines limit the liability of the cardholder to only RM250 when loss is reported promptly.

Apandi held that “the bank’s attempt to modify these guidelines and to remove this protection was contrary to law and public policy”.

The decision of the High Court also declared the bank to be in contravention of the Payments Systems Act that could subject the organisation to a maximum penalty of RM500,000 and a further fine of RM1,000 per day as long as the offence continues.

Chee, 25, said she was relieved and grateful that her ordeal was over as the charges would have amounted to almost her entire month’s salary.

She was also thankful that a senior counsel had agreed to take up her case and refer the matter to the High Court for a ruling.

“I lodged a complaint with Bank Negara but no action was taken by the Central Bank to enforce the guidelines it had issued,” Chee told Malay Mail. “I also didn’t receive any conclusive reply to my complaint.”

Chee said she was adamant not to give in and had no alternative but to seek redress from the court. However, legal cost was a worry for her. “I am thankful that my counsel agreed to take up the case. I sincerely hope that Bank Negara will now ensure that card issuers follow the guidelines and take all necessary action to protect consumers like me.

This case highlighted by Malay Mail is exactly the same as the case that I had posted in my blog in Your MP’s Question of the Week #53 (on 28 April 2009), which concerned one Mr Hoo involving MBF Cards (M’sia) Sdn Bhd (MBF). MBF had insisted that Mr Hoo pays for the sum of RM8,808.52 as he was late in reporting the loss of his card. MBF instructed their lawyer to threaten to sue Mr Hoo. I intervened to assist Mr Hoo against the threat made by MBF. Up to this date MBF has yet to file a suit against Mr Hoo.

On 27 April 2009 I had officially lodged a formal complaint against MBF for gross violation of Clause 15 of the Bank Negara Guidelines On Credit Cards but until this date I have not received any acknowledgement let alone a reply from Bank Negara regarding the said report.

Now that the learned Justice YA Datuk Mohamed Apandi Ali has held that Citibank has contravened the Payment Systems Act that is subjected to a maximum penalty of RM500,000 and a further fine of RM1,000 per day as long as the offence still continues. Bank Negara is therefore obliged to act.

Based on the said decision by the learned Judge, and since MBF has not withdrawn their demand sent by their lawyer, Bank Negara is duty bound to investigate and prosecute MBF for the said offence. In any event I have already tabled a Parliamentary Question (view here) pertaining to the report lodged against MBF which will be answered in this June 2009 Parliamentary Session. The Minister of Finance should reprimand Bank Negara for not responding to a complaint lodged by a Member of Parliament against a credit card company, which is MBF.

I am certain that Ms Chee and Mr Hoo were not the only two cases involving Citibank and MBF.

Sangat ingin mengucapkan tahniah kepada Hakim YA Datuk Mohamed Apandi Ali kerana memutuskan bahawa Garis Panduan Bank Negara ke atas Kad Kredit mempunyai kuasa undang-undang ke atas semua pihak yang berkenaan. Beliau juga memutuskan bahawa garis panduan memang menghadkan jumlah tanggungan kepada pemegang kad hanyalah setakat RM250 jika kehilangan itu dilaporkan dalam tempoh yang singkat.

Apandi memutuskan bahawa “percubaan bank mengubah garis panduan dan mengeluarkan syarat perlindungan ini adalah bercanggah dengan undang-undang dan dasar umum.”

Keputusan Mahkamah Tinggi mengisytiharkan bahawa pelanggaran Akta Sistem Pembayaran yang boleh menyebabkan syarikat kad kredit dikenakan denda paling tinggi RM500,000 dan tambahan denda RM1,000 sehari selagi kesalahan ini masih berterusan

Chee, 25, melafazkan perasaan lega danbersyukur bahawa kesengsaraannya telah berakhir kerana kadar bayaran itu akan menelan hampir semua gaji sebulannya.

Beliau juga bersyukur kerana seorang peguam berpengalaman bersetuju mewakilinya dalam kes ini dan merujuk kepada Mahkamah Tinggi untuk keputusan.

“Saya telah membuat aduan kepada Bank Negaratetapi tidak ada tindakan diambil untuk menguatkuasakan Garis Panduan,” Chee memberitahu Malay Mail. “saya juga tidak menerima sebarang jawapan ke atas aduan saya.”

Chee berkata bahawa beliau tegas tidak mahu mengalah dan tidak mempunyai pilihan selain daripada mendapatkan bantuan daripada pihak mahkamah. Walau bagaimana pun, perbelanjaan peguam adalah masalah yang membelengguinya sekarang. “Saya berterima kasih kepada peguam yang sudi membantu saya. Saya berharap Bank Negara kini menguatkuasakan Garis Panduan ini dan mengambil tindakan yang sewajarnya untuk melindungi pengguna seperti saya.

Kejadian yang dilaporankan oleh Malay Mail sama sekali dengan kejadian yang saya telah laporkan dalam blog saya dalam Soalan Mingguan WR Anda #53 (pada tanggal 28 April 2009), di mana melibatkan seorang bernama En Hoo dan MBF Cards (M’sia) Sdn Bhd (MBF). MBF menekan En Hoo supay amembayar jumlah RM8,808.52 atas sebab beliau lambat melaporkan kehilangan kadnya. MBF juga mengarahkan peguam mereka mendakwa En Hoo. Saya campur tangan membantu En Hoo melawan gertakan MBF. Sehingga kini MBF belum lagi memulakan kes dakwaan terhadap En Hoo.

Pada 27 April 2009 saya telah membuat aduan rasmi terhadap MBF kerana melanggar Klause 15 terhadap Garis Panduan Bank Negara ke atas Kad Kredit tetapi sehingga kini saya belum lagi menerima sebarang pengesahan penerimaan apatah lagi jawapan daripada Bank Negara terhadap laporan ini.

Kini Hakim YA Datuk Mohamed Apandi Ali telah memutuskan bahawa Citibank telah melanggar Akta Sistem Pembayaran yang boleh membawa denda paling tinggi RM500,000 dan tambahan denda RM1,000 sehari selagi kesalahan ini masih berterusan.

Berdasarkan keputusan Hakim, dan memandangkan bahawa MBF belum lagi membatalkan surat peguam mereka, Bank Negara bertanggungjawab menyiasat dan mendakwa MBF atas kesalahan tersebut. Walau bagaimanapun, saya telah menyediakan satu Soalan Dalam Parliamen (sini) mengenai laporan saya MBF yang akan dijawab dalam sesi Parlimen Jun ini. Menteri Kewangan harus menegur Bank Negara kerana tidak menjawab aduan rasmi oleh seorang Ahli Parlimen terhadap sebuah syarikat kad kredit iaitu MBF.

Saya pasti Puan Chee dan En Hoo bukanlah mangsa sahaja yang membabitkan Citibank dan MBF.

我为博学的YA Datuk Mohamed Apandi Ali法官在信用卡事件上坚认国行指南对全马类似的公司仍能起“法律效力”表示祝贺。他也认同指南所列明关于持卡人的债务只限于RM250若在遗失后第一时间汇报。

高庭也议决宣称若银行违反付款系统法令,组织机构很可能会遭受最高RM500,000的刑罚以及附加每日RM1,000的款项只要违法行为持续发生。

Chee, 25,声说她已解除债务及庆幸她的遣债总数高达整一个月薪金的苦难已告一段落了。

她也感激一位资深律师同意接她的案子及把这课题交由高庭裁决。

“我向国行正式提出投诉但银行总部并没有强制执行以发出的指导方针,”Chee告知Malay Mail. “对于我的投诉,我也没有接获任何确凿的回复。”

Chee 说到她是坚决不让步的以及没有其他途径除了向法庭寻求申诉。然而,她也为律师费用问题感到忧心。“我很感谢我的代表律师同意接这宗案子。我衷心地希望国行能从现在起确保分发信用卡者遵从该指南并且采取务必的行动来保障所有类似我这样子的消费者。

Malay Mail 所强调的这总案子就如我在部落格,您的国会议员议题之#53(2009年4月28日)中提及的一样,涉及Mr Hoo 与 MBF Cards (M’sia) Sdn Bhd (MBF)。MBF坚决要求Mr Hoo缴付总额RM8,808.52因他迟了汇报信用卡遗失事宜。MBF指示其代表律师控告Mr Hoo。我介入协助Mr Hoo抑制MBF的威胁。到目前为止,MBF还未对Mr Hoo的诉讼存档。

依据资深法官的裁决,由于MBF没有撤回他们律师所发出的要求,国行有义务调查及检举MBF的违法行为。无论如何,我已经提呈有关正式举报MBF的国会议题,有关议题将会在2009年6月会期中作出答覆。财政部长应斥责国行未对于MBF投诉事件给予国会议员任何的回复。

我确信涉及Citibank 以及MBF 的案例并不只是局限于Ms Chee 与 Mr Hoo 。

    Why is Bank Negara waiting before acting against MBF? Bank Negara must protect public interest and not the interest of MBF. MBF is a big bully. MBF knew that about the Bank Negara Guidelines and yet it still try to force the innocent card holder to pay for something that someone else spent.

    Bank Negara must act now in order to set example so that other credit companies follow strictly to the Bank Negara Guidelines.

    Whether it is MBF or not, card holders facing such bully tactics of the credit card should lodge a report with Bank Negara as advised by YB Wee. We know Bank Negara will not take actions against big credit companies. But we must swamped them with the complaints and informed our MPs so that Bank Negara’s attitude can be exposed in Parliament.

    YB please post the answer you received from the Minister of Finance regarding your question on MBF. I am curious to know what excuses Bank Negara will come up with.

    Sadly to say that “Harap Pagar Pagar Makan Padi” is the best description of our Bank Negara in this matter. I don’t udnerstand why Bank Negara is so scared to act against MBF, just another credit company. I am sure that Bank Negara has no interest in credit companies.

    Lets see what stupid answer the Minister of Finance is going to give on this matter.

    Congratulation to Justice Datuk Mohamed Apandi Ali for standing up for the law and the small people of Malaysia. We need more judges like this to protect public from being exploited by big financial institution like Citibank and MBF.

    Bank Negara, wake up! Now that the High Court has said that the Guidelines have the force of law. Bank Negara should now charge MBF for going against the Guidelines in order to set example for others to follow.

    I don’t understand why is Bank Negara still asleep over this matter.

    Why must Bank Negara be blamed in this matter. The Consumer Protection element is Bank Negara’s doing. The introduce the legislation.

    Now, it the public that should be lauded. With greater awareness of the protection provided by the government individuals and leaders like YB Wee have managed to bring this level of awareness through the legal system and secured a confirmed position that yes, that legislation of RM250 was indeed in favor of the consumers. That decision would be binding to other similar cases in future. Banks would now have to be more responsive and accountable in their consumer protection aspects over the profit principle. They should put a better mechanism in place to ensure fairness on these instances. All banks not only MBF.

    The heroes here are you people, leaders, Bank Negara for introducing the legislation and the High Court for putting the interest of consumers(like you and me) over big business like CitiBank or MBF.

    Score one for the small people.

    Syabas dan tahniah diucapkan kepada Hakim YA Datuk Mohamad Apandi Ali kerana membuat perentah bahawa Garis Panduan Bank Negara keatas kad kredit mempunyai kuasa undang undang keatas semua pihak yang berkenaan. Dalam Garis Panduan tersebut memang menghadkan jumlah tanggongan kepada pemegang kad kredit hanyalah setakat RM250.00 sahaja.

    Dengan adanya garis panduan ini rakyat akan berasa lega dan tidak lagi menjadi mangsa buli dari instituisi kewangan seperti Citibank dan MBF. Walau bagaimana pun Bank Negara Malaysia harus memantau dan mengambil tindakan undang undang jika ada pihak bank mematuhi arahan Garis Panduan tersebut.

    Kepada YB Wee juga diucapkan tahniah kerana telah menyiarkan berita ini dalam laman web ini. Saya juga berharap agar YB dapat menyiarkan jawapan dari Menteri Kewangan berkenaan perkara ini yang akan dibangkit dalam sidang Parlimen.     Bank Negara, what are you waiting for? Take actions against MBF and other credit companies who have violated your own Guidelines.

    I just cannot understand why Bank Negara dare not take action against MBF. I wonder why?????

    Even President Obama has signed sweeping credit card reforms into law to shield American credit holders from the abused by credit companies i.e. from predatory fees and others.

    Here in Malaysia, Bank Negara was not acting on official complaint from MP. Why is Bank Negara was so scared of MBF. Is MBF that great and powerful.

    We demand that Bank Negara governor, Tan Sri Zeti, to wake up and protect public interests and control credit card companies like MBF and Citibank to stop exploiting members of the public. I am certain that there are many more such cases.

    Consumers/credit card holders whether from MBF or other companies, please stand up and lodge as many complaints as possible to Bank Negara so that it will have to protect members of the public for a change!

    Bank Negara officers: Are you all asleep? Wake uplah to protect the people. Your gaji are paid by the rakyat not by MBF. This is a clear case of violations of Bank Negara Guidelines on Credit Card. Why waiting?

    Charge MBF in court immediately and the other credit companies will toe the line.

    Bank Negara, your existence is to regulate these legal “Loan Sharks” and protect the people. But you are now protecting the credit card company (MBF).

    YB Wee, please whack Bank Negara in Parliament for not performing their duties and for protecting MBF.

    Tell me. When has Bank Negara ever taken action against any bank for abuse of rules.
    These banks break all sorts of bank rules with impunity and yet get away scot-free.
