Sodomy trial: Anwar wins first round

The Kuala Lumpur Sessions Court today ruled in favour of Opposition Leader Anwar Ibrahim and decided that his sodomy trial would be heard in the same court.

anwar ibrahimDelivering the ruling this afternoon, judge SM Komathy Suppiah had ruled that the transfer order signed by Attorney-General Abdul Gani Patail was invalid.

The court fixed next Friday for mention.

The decision will pave the way for the sodomy trial to begin – three months after Anwar claimed trial after being charged with sodomising his former aide, Mohd Saiful Bukhari Azlan, 23.

If convicted, he could face up to 20 years in jail. He is currently out on a RM20,000 personal bond.

AG’s role disputed

In previous arguments on the case transfer, Anwar had objected to the application because the transfer certificate was signed by Abdul Gani.

The defence team’s objection was on the basis that the AG should not have played any role in this case as he is being investigated for allegedly having tampered with evidence in Anwar’s trials 10 years ago.

The defence has also argued that Prime Minister Abdullah Ahmad Badawi had given an assurance that Abdul Gani would not be involved in the case.

    Mahkamah Seksyen Kuala Lumpur Sessions membuat keputusan memihak kepada Ketua Pembangkang Anwar Ibrahim dan memutuskan bahawa perbicaraan liwatnya kekal di mahkamah sama.

    Semasa menyampaikan keputusannya hakim SM Komathy Suppiah membuat keputusan bahawa perintah pindah perbicaraan yang ditandatangani oleh Attorney-General Abdul Gani Patail tidak sah.

    Pihak mahkamah menetap permulaan perbicaraan jumaat depan

    Keputusan ini membolehkan bermulanya perbicaraan kes liwat – 3 bulan selepas Anwar minta perbicaraan selepas didakwa meliwat bekas pembantunya, Mohd Saiful Bukhari Azlan, 23.

    Jika didapati bersalah, beliau mungkin dikenakan penjara 20 tahun. Sekarang beliau diikat jamin RM20,000.

    Peranan AG dipertikaikan

    Dalam perbahasan mengenai pindahan pembicaraan, ANwar membantah pemohon memindah perbicaraan kerana sijil perintah pindah telah ditanda tangani oleh Abdul Gani.

    Bantahan pihak pembela Anwar adalah berdasarkan AG tidak boleh bermain sebarang peranan kerana beliau sedang disiasat sama ada menganggu bukti bersabit dengan perbiaraan Anwar 10 tahun lalu.

    Pihak pembela Anwar juga membentangkan bahawa Perdana Menteri Abdullah Ahmad Badawi telah berjanji bahawa Abdul Gani tidak akan terlibat dalam kes ini

    Thank God we still have judge who are faithful in their calling to dispense justice when it is needed. I salute you SM Komathy Suppiah and please know that truth will eventually prevail in any circustances.

    We as citizens of Malaysia are perplexed to know what the MSMs’ are spinning each day. The news that are usually against opposition MPs’ are usually highlighted whereas those committed by the BN with regards to corruption etc are mainly worded to be read without much fanfare.

    Take note of this case and let us see how it will end as the amount involved are into millions with the frozen account of over RM 100 mil. This is on Sabah where the allegations of money laundering was being tracked for over three years now as mentioned by ICAC of Hong Kong. Interestingly, the man that was caught with briefcase full of CASH was said by some to be a top aide of the top govt people in Sabah.

    What an irony when the poor there are fighting for their customary lands and the super rich are flying around with full cash in their cases. This is just one case caught red handed and only God knows how many more illegal accounts are residing in offshore banks.
