Meeting with Datuk Bandar at DBKL on 26 May 2009

Meeting between Yg Bhg Datuk Ahmad Fuad bin Ismail, Datuk Bandar Kuala Lumpur, and all the MPs in Wilayah Persekutuan at DBKL on 26th May 2009 from 5.00 to 7.50 pm

At the meeting I brought up the following issues for discussion:

1. DBKL’S Clients Charter (Piagam Pelanggan)

Under the DBKL Clients Charter, all departments in DBKL must reply to all letters and complaints from members of the public within 7 days. Datuk Bandar corrected me and said that under the present “Delivery System” policy all departments must reply letters and complaints within 3 days.

I gave Datuk Bandar a clear example whereby Tuan Ramly Othman, the Pengarah of Jabatan Pengurusan Peniaga Kecil, after informing me in writing that one of the reasons DBKL cannot take action against a hawker for setting up a stall with permanent structures just a few feet from the traffic light in Section 2 in Wangsa Maju. The reason given was that “the hawker set up the stall before the existence of the traffic light (i.e. the stall was there before the traffic light). Tuan Ramly Othman’s letter was copied to Datuk Hj Amin, the Timbalan Pengarah of Pentadbiran of DBKL (the number three man in DBKL). I told Datuk Bandar that Datuk Amin didn’t even bother to correct the stand taken by Tuan Ramly Othman.

I responded with another letter to Tuan Ramly Othman to ask for clarifications:

a. How could a “gerai” be constructed with permanent structures measuring more than 30 feet by 10 feet and located a few feet away from the traffic light?

b. How could his department approve and renew the Hawker Licence when it is no longer a gerai (due to the permanent structures) and situated on government land without TOL or approval from the Pejabat Tanah dan Galian?

c. Whether it is the new policy of DBKL that no action can be taken against a hawker if the hawker was at the location before the arrival of a development?

Some 21 days had elapsed and Tuan Ramly Othman did not bother to respond and as far as I know Datuk Amin did not bother to discipline Tuan Ramly Othman for breaching DBKL’s Clients Charter and the Delivery System of 3 days. This is the sorry state of affairs in DBKL where a high ranking officer like Datuk Amin did not bother to ensure that the officers under him do not write stupid letters and must respond to letter within 3 days.

I also pointed out to Datuk Bandar that if a DBKL officer cannot be bothered to  respond to letters from a MP then members of the public will be treated like dirt.

Datuk Bandar promised to look into this matter and take the necessary action.

Note: Up to 28th May 2009 Tuan Ramly Othman was still very arrogant and refused to provide me with any reply. I had written officially to Datuk Amin, the Timbalan Pengarah for Pentadbiran to initiate disciplinary actions against Tuan Ramly Othman. I very much doubt if Datuk Amin will act because he is just a “dua kali lima” to Tuan Ramly Othman. As far as I am concerned, the DBKL’s Clients Charter is a big joke because the officers do not follow it. It should be thrown into the drain.

2. Fighting Crimes in Wangsa Maju

I pointed out to Datuk Bandar that fighting crimes is not the sole duty of the police but also the duty of DBKL. I suggested that DBKL should have a campaign to light up dark places in KL in order to reduce crimes. Datuk Bandar was receptive to this suggestion and promised to look into this matter.

3. Tables and Chairs placed on Car Park Lots

My office had received many complaints about coffee shops having blocked car park lots to place tables and chairs, thereby depriving members of the public parking spaces. This practice is not only rampant in Wangsa Maju but throughout Wilayah Persekutuan and Selangor. This perpetual activity also poses a danger to public safety.

Datuk Bandar had expressed his disapproval of such practices.  He had acknowledge the danger of such practices, too.

4. Uptown Pasar Malam in Danau Kota

I had received many complaints about this Pasar Malam that starts at about 9 pm and finished at about 4 am. Moreover it is located at a residential area.  The residents had continuously complained about the noise, crimes and cars that were parked at their gates. It appears very unhealthy for Bandaraya to encourage a “Lepak Culture.” I proposed that this Pasar Malam be relocated to a place that is far away from a residential area or alternatively to start opeation at about 8 pm and end at mid-night.

Datuk Bandar promised to look into this matter.

5. CyberCafés Operating After Mid-night

During the last meeting about 3 months ago,  I had brought up the subject of cybercafés operating until early hours in the morning and some of them were promoting gambling online.

Datuk Bandar had informed the meeting that on 5 March 2009 DBKL Legal Department had submitted proposals to amend the laws to the Ministry of Wilayah Persekutuan. DBKL is awaiting further action from the Ministry.

6. Kuala Lumpur Draft Plan 2020

Hakmilik GM 3945 /5537 in Sri Hartamas had been zoned for Masjid Desa Sri Hartamas under the K L Draft Plan Map 129. This land is located next to the police station and Fire Brigade in Sri Hartamas. Glomac was the developer of this land in question. This land was given to Majlis Ugama Wilayah Pesrsekutuan for the building of a Masjid.

Suddenly the use of this land had been changed from Masjid to commercial and DBKL had granted a Development Order for construction of commercial building.

Datuk Bandar was equally shocked by this decision. It must be noted that this Development Order was granted under the previous Datuk Bandar, Datuk Hakim Borham. Datuk Bandar had promised to look into this matter.

7. Road Widening of Jalan Gombak

I had received many complaints that the road widening project in Jalan Gombak had taken too long and the road condition is very poor. I also told Datuk Bandar that I had received an assurance from YB Datuk Zulhasnan, the previous Minister of Wilayah Persekutuan, that the said road widening project will be completed by end of May 2009.

Datuk Bandar also said that he was also very unhappy about the delay. He said that he had received an assurance from one of his officers that it will be completed  in July 2009.

8. Telco Dishes and Antennas on top of Shop Houses and Residential Homes

I brought to the attention of Datuk Bandar that many of the telco dishes and antennas had been put up without approval or were located not in accordance with approvals given.

I also informed Datuk Bandar that these telco dishes and antennas are a danger to public health and Datuk Bandar had agreed to look into this matter. In the interim, he promised to tear down those telco dishes and antennas that were put up without approvals from DBKL.

Note: I had been informed by DBKL that Datuk Bandar had given specific instructions to tear down all illegal telco dishes and antennas.

Mesyuarat dengan Datuk Bandar di DBKL pada 26 Mei 2009

Mesyuarat antara Yg Bhg Datuk Ahmad Fuad bin Ismail, Datuk Bandar Kuala Lumpur, dengan semua WRWilayah Persekutuan di DBKL pada 26 Mei 2009 dari pukul 5.00 hingga 7.50 malam.

Saya telah membangkikan perkara berikut dalam mesuarat tersebut:

1. Piagam Pelanggan DBKL

Menurut PP DBKL, semua jabatan DBKL mesti menjawab semua surat dan aduan daripada awam dalam masa 7 hari. Datuk Bandar membetulkan saya dan menyatakan bahawa menurut sistem penyerahan kini, semua jabatan mesti jawap semua surat dan aduan dalam tempoh 3 hari.

Saya memberi satu contoh jelas kepada Datuk Bandar di mana Tuan Ramly Othman, Pengarah Jabatan Pengurusan Peniaga Kecil, yang telah memaklumkan saya secara bertulis bahawa salah satu sebab mengapa DBKL tidak boleh bertindak terhadap seorang penjaja yang telah membuat gerainya yang berstruktur kekal hanya beberapa kaki daripada lampu isyarat di Seksyen 2, Wangsa Maju. Sebab yang diberinya adalah “penjaja itu telah membuat kedainya sebelum adanya lampu isyarat itu”. Surat Tuan Ramly Othman itu telah disalinkan kepada Datuk Hj Amin, Timbalan Pengarah Pentadbiran DBKL (orang ketiga DBKL). Saya memberitahu Datuk Bandar bahawa Datuk Amin langsung tidak ambil tindakan untuk memperbetulkan pendirian Tuan Ramly Othman.

Saya telah memberi maklum balas dengan sepucuk surat lagi kepada Tuan Ramly Othman minta penjelas mengenai:

a. Bagaimanakan sesebuah “gerai” boleh dibina dengan struktur kekal yang lebih besar daripada 30 kaki kali 10 kaki dan hanya terletak beberapa kaki daripada lampu isyarat?

b. Bagaimanakah jabatannya boleh meluluskan dan memperbaharui lesen penjaja apabila pemilik lesen itu bukan lagi mengelolakan sebuah gerai sahaja (kerana struktur kekalnya) dan berniaga di atas tanah kerajaan tanpa TOL (lesen menduduki sementara) atau kebenaran daripada Pejabat Tanah dan Galian?

c. Adakah ini dasar baru DBKL di mana tindakan tidak boleh diambil ke atas seseorang penjaja jika penjaja ity telah berniaga di sesuatu tempat sebelum datangnya kegiatan pembangunan?

Setelah 21 hari dan Tuan Ramly Othman bersikap tidak peduli untuk menjawab surat saya dan setakat dalam pengetahuan saya, Datuk Amin tidak mengambil tindakan disiplin ke atas Tuan Ramly Othman kerana melanggar PP DBKL dan peruntukan sisterm penyerahan 3 hari. Inilah keadaan yang menyedihkan dalam DBKL di mana pegawai tinggi seperti Datuk Amin tidak peduli sama ada pegawai bawah kawalannya tidak menulis surat berisi bodoh dan mesti menjawab surat dan aduan dalam tempoh 3 hari.

Saya juga memberitahu Datuk Bandar bahawa jika pegawai DBKL tidak peduli menjawab surat Wakil Rakyat maka ini bermakna orang awam seperti dianggap sebagai “Lumpur” sahaja.

Datuk Bandar janji akan menyiasat lanjut perkara ini dan akan mengambil tindakan yang berpatutan.

Nota: Sehingga 28 Mei 2009 Tuan Ramly Othman masih sungguh angkuh dan enggan memberi sebarang jawapan. Saya telah berutus kepada Datuk Amin, Timbalan Pengarah Pentadbiran supaya memulakan tindakan disiplin terhadap Tuan Ramly Othman. Saya tidak yakin bahawa Datuk Amin akan bertindak kerana beliau hanyalah “dua kali lima” kepada Tuan Ramly Othman. Setakat pengetahuan saya, PP DBKL hanyalah tipu-jenaka sahaja dan harus dicampak dalam longkang.

2. Memerangi jenayah di Wangsa Maju

Saya memaklumkan Datuk Bandar bahawa usaha memerangi jenayah bukanlah hanya tugas pihak polis tetapi juga tugas DBKL. Saya mencadangkan bahawa DBKL harus mengadakan gerakan memasangkan lampu di tempat-tempat malap Kuala Lumpur untuk mengurangkan kadar jenayah. Datuk Bandar menerima cadangan ini dengan baik dan berjanji akan mendalami perkara ini.

3. Meja dan kerusi di atas tempat letak kereta

Pusat perkhidmatan saya banyak menerima aduan bajawa kedai kopi telah mengambil alih tempat letak kereta dengan meletakkan meja dan kerusi di atas situ, seterusnya merampas hak orang awam menduduki tempat letak kereta. Gejala ini bukanlah hanya berleluasa di Wangsa Maju bahkan seluruh Wilayah Persekutuan dan Selangor. Gejala yang berlanjutan ini juga membahayakan keselamatan awam.

Datuk Bandar menyatakan perasaan tidak setuju dengan amalan ini. Beliau juga mengambil tahu mengenai betapa bahayanya amalan ini.

4. Pasar Malam Uptown di Danau Kota

Saya telah menerima aduan yang banyak mengenai Pasar Malam ini yang bermula lebih kurang 9 pm dan tutup pada pukul 4 am. Lebih-lebih lagi ia terletak dalam kawasan perumahan. Penghuni di situ telah lama mengadu mengenai kebisingan, jenayah dan masalah letak kereta di pintu masuk rumah mereka. Tidak eloklah jika DBKL menggalakkan budaya lepak” Saya mencadangkan supaya Pasar Malam dipindahkan ke tempat yang lebih jauh daripada kawasan perumahan atau bermula dari pukul 8 malam dan berakhir pada tengah malam.

Datuk Bandar berjanji akan mendalami perkara ini.

5. CyberCafés berniaga selepas tengah malam

Semasa meyuarat terakhir 3 bulan dulu, saya telah membangkitkan perkara mengenai kegiatan pusat cybercafe yang berniaga hingga awal pagi dan menggalakkan kegiatan berjudi menerusi internet

Datuk Bandar telah memaklumkan saya bahawa pada 5 Mei 2009 Jabatan Perundangan DBKL telah menyerahkan cadangan perubahan rang undang-undang kepada Menteri Wilayah Persekutuan. DBKL kini menunggu tindakan daripada pihak kementerian.

6. Pelan Draf Kuala Lumpur 2020

Tanah hakmilik GM 3945 /5537 di Sri Hartamas telah diperuntukan untuk tujuan Masjid Desa Sri Hartamas bawah Pelan Draf K L nombor 129. Tanah ini terletak di sebelah balai polis dan bomba di Sri Hartamas. Glomac adalay syarikat pemaju tanah tersebut Tanah ini telah diberi kepada Majlis Ugama Wilayah Pesrsekutuan untuk tujuan mendirikan satu Masjid.

Tiba-tibanya penggunaan tanah ini telah diubah kepada tujuan kommersial daripada pembinaan Masjid dan DBKL htelah mengeluarkan Perintah Pembangunan untuk tujuan membina bangunan kommersial.

Datuk Bandar amat terkejut dengan keputusan ini. Patut diketahui bahawa Perintah Pembangunan ini telah dikeluarkan semasa penggal Datuk Bandar yang lepas, Datuk Hakim Borham. Datuk Bandar berjanji akan menyiasat perkara ini.

7. Kerja memperluaskan Jalan Gombak

Saya telah menerima banyak aduan bahawa kerja Jalan Gombak telah mengambil masa yang terlalu panjang dan keadaan jalan sangat teruk. Saya juga memaklumkan Datuk Bandar bahawa saya telah menerima kenyataan janji YB Datuk Zulhasnan, bekas Menteri Wilayah Persekutuan, bahawa kerja emperluaskan jalan ini akan disiap menjelang hujung bulan Mei.

Datuk Bandar juga menyatakan bahawa beliau sungguh tidak puas dengan kelewatan ini. Beliau berkata bahawa beliau telah meneima kata janji daripada salah seorang pegawainya bahawa kerja ini akan siap menjelang bulan Julai 2009.

8. Cakera Syarikat Telekominikasi dan Antena di atas rumah kedai dan rumah kediaman

Saya telah memaklumkan Datuk Bandar bahawa banyak cakera telekomunikasi dan antena telah dipasang tanpa kebenaran ataupun tidak mengikut syarat kebenaran.

Saya juga memberitahu Datuk Bandar bahawa cakera dan antenna ini adalah ancaman terhadap kesihatan umum dan Datuk Bandar telah berjanji akan mendalami perkara ini. Buat sementara waktu, beliau berjanji akan merobohkan cakera telekomunikasi dan antenna yang tidak mempunyai kebenaran daripada pihak DBKL.

Nota: Saya telah dimaklumkan oleh DBKL bahawa Datuk Bandar telah memberi arahan khas supaya semua cakera dan antenna yang dipasang tanpa kebenaran dirobohkan.

  1. Mana RM 4.6 Ribu Juta?

    Abdullah Ahmad Badawi telah mengumumkan RM 4.6 Billion sebagai peruntukan memperkasa pengangkutan awam.

    RM 4.6 Billion bukan kecil anak. Ianya satu jumlah yang tak tercapai dek akal saya. Namun keadaan tetap sama. Bas RapidKL berjalan tidak ikut jadual. Rakyat tersepit persis sardin dalam tin dalam gerabak LRT. Penumpang Komuter juga turut menderita lemas dari Seremban ke KL Sentral.

    Lalu rakyat pun bertanyalah. “Mana pergi RM 4.6 Billion ini?” Sepatutnya selepas duit sebanyak ini diperuntukkan pastilah ada perubahan drastik terhadap sistem pengangkutan awam.

    Memandangkan saudara sangat peka dalam pengangkutan, saya berharap hal – hal ini dapat diberi perhatian.

    Teruskan berkhidmat, Wee Choo Keong MP Wangsa Maju.

    frankly base on historical track records, it might 3 days for some pegawai to read the title of the letters

    does DBKL has any staff appraisal system to appraise, improve or release their manpower like a viable commercial entity? I guess not.

    thanks for the insiders’ view of the attitude, aptitude of some of the consumers of our tax and rate monies. the matters you raised are reasonable, within the control of DBKL and it is the lack of will that is frustrating the residents of KL

    There is also an inconsistency in implementation. How can that gerai be left unattended when swiftly after the GE, the Desa Setapak stalls were “tsunami-ed” themselves?

    perhaps in the next meeting, in addition to following up matters arising, perhaps one should examine with DB that if there is any bias or inconsistency in enforcement.

  3. 1) That pasar malam is a disturbance to the public. Needs to be shifted far away from the houses in the vicinity. How to sleep like this.

    2) I try to avoid driving into Desa Setapak nowadays. It’s not for cars- no parking, double parking on the road, etc> might as well convert the place into an open-air pedestrian mall. Convert all car park lots into gerai. Encourage entrepreneurship.

    3) By selective demolition of hawkers lots in May 2008, DBKL nearby created another May 13. DBKL are bloody racists.

  4. Dear YB, i refer to issue 8, that was raised during your meeting with the Datuk Bandar at DBKL on 26 May ’09, where the following ‘NOTE’ inserted:

    Note: I had been informed by DBKL that Datuk Bandar had given specific instructions to tear down all illegal telco dishes and antennas.

    I would like to know what is DBKL’s action against my complaints for the past 10 years on the premise owner that had telco dishes and antennas fixed next to my mum’s and my own bedroom? As far as i am aware these telco antennas built than were illegal until after my last complaint to DBKL 15 May 2008. Please don’t tell me that it is now given an approval!!

    You had also mentioned to the Datuk Bandar of the danger exposed to the public health. The Datuk Bandar should have known this better and should not delay to look into this matter, especially my case as it has been 10years now. My family been directly exposed to it day and night all these 10 years. I was not even 40 when i was diagnosed with rheumatism 7years ago and my neighbour is down with parkinson recently. Could this be the effect of these telco towers?

    After my complaint to you few months back, you had personally called me to assure me that the matter will be solved as soon as possible. As at today 5 June 2009 these giants are standing still on the roof top of the shophouse next to my residence.

    My heart goes out to people like setapak garden.I too live in setapak garden and it’s no longer the place I used to know as my resting place after work.

    DBKL under Hakim Borhan was arrogant & haughty.Let’s hope & pray our new Datuk bandar will have a heart for us.

    Where does the ordinary rakyat go to get attention?

    I salute you for bringing up the problem of Wangsa Maju straight to Datuk Bandar. This show us you are with us feeling the agony of living in the nice place which turn into an ugly place by some irresponsible people.
